So I had to take 3 months off from work to recover from an accident related surgery. I didn’t receive my daily allowance for being off recovering until months after I had returned to work (another story..) Each month when I receive my payslip, the cumulative total for my 13th month payments are added at the bottom, with the actual payout coming in December.
Once I returned to work I noticed that in following payslips I had not received any 13month payments into my “pot” during the period I was off work, and when I finally received my daily allowance money there was still no additional 13th month payments added on to the running total on my payslips.
My questions is: do we earn 13th month during time off work due to an accident or is that amount already included in the daily allowance payments so is not a part of the total at the end of the year? Or am i just being messed around and I need to speak to my employer about missing money? (He’s not the most trustworthy employer)
"The 13th month's salary is included in sickness, accident and EO daily allowances. In the event of continued payment of wages during the waiting period (waiting days) and an increase in the daily allowance to 90 percent or 100 percent by the employer, a 13th month's wage is owed on these wage components. If, on the other hand, only the daily allowances are paid to the employees via the employer, no 13th month's salary is due on these. This means that at the end of the year, only a reduced 13th month's salary is often due if the employee is unable to work. "

I’m on a 100% hourly contract. So no set monthly salary. The contract is very basic, written by a small business owner with not too many specifics, so is not particularly useful for clearing this stuff up. As mentioned above, asking my employer for clarity is not a reliable option.
