Agency not responding to applicants

Hello everyone,

I am having some serious issues with an unresponsive and unprofessional agency.

I resigned my lease early for the 1st August, back in May, knowing I would have to find a replacement tenant.

I have handed over 8 dossiers and each time the agency took 3 weeks to reply and in the meantime these applicants had found appartments whose agencies took 2-3 days to reply.

Now the agency have stopped responding to my emails & have not responded to an applicant i sent them 1 month ago, who was solvent.

I am now wondering what I can do, they are clearly not responding because I'm still liable for rent and they are happy with that situation.

Is there a limit on the amount of time they can take to respond? Surely, with the last applicant I sent them a month ago, I can say I have sent you a solvent applicant and you haven't responded in a month.

You have done your part, all it takes is really only 1 - 2 solvent clients.

Its not your problem how long the agency takes to reply.

If you left in august why are you still involved?

I think you will find one of those solvable clients needs to sign an agreement for takeover before it is accepted.

The agency has up to 14 days to decide on an replacement tenant. If within those 14 days your replacement tenant is no longer willing to sign the contract, because they found something else or they are no longer interested, you have to find and present a new replacement tenant.

Three weeks is way to long and you should have pressed things much sooner. If the current replacement tenant is still willing to sign you have royal flush, plus an ace up your sleeve and a jocker in your sock.

Since no one has mentioned it yet - this is a perfect reason to join and contact the Mietverband . Another EF user described that the Mietverband provides expert legal advice for apartment rental issues for a fraction of the cost of a lawyer.

Based on the above responses, it seems I can write to them to say they have not responded to a suitable candidate within one month and I am therefore released from my obligations.

Believe me I tried. I called them every day and was always promised a response the next day.

I did not want to resort to ultimatums as I thought that would make them angry and just drag it out even further, since I am liable to pay the rent anyway.

I have similar experience so far. My rent will slip only 2 months. The agency told me to give them one candidate to be released from obligations but they reserve the right to advertise it and asked for my phone to put in the ad So I advertised it myself, gave away all the QR codes in just 2 viewing sessions. However I haven't heard from the agency yet and some people keep asking me if it was already rented.

Update:

After speaking to ASLOCA, I sent a letter to the reĢgie to say since they did not respond to one solvable applicant for over 30 days (and still haven't) that I consider myself released from the lease (unless they respond otherwise).

So far no response, it has been 10 days but they never respond to anything anyway.

I am sure they will send a letter soon asking for october rent without acknowledging my letter.

I've been contacted over a week ago by one of the candidates sourced by me that he got the apartment. We arranged a second visit later this month to check furniture takeover. Now, the funny part is that the agency is quiet about that fact. I thought they'll send me a snail mail and forgot about the topic but so far I received nothing I couldn't care more, they have signed the contract so certainly have to rent the apartment.
