I work for a company in Montreux, I have another job offer starting in Feb 2022 in Morges at a multinational but wish to take 4 weeks vacation to visit family in Canada. I booked 4 weeks of vacation off for almost all of Jan in 2022 which was approved by my manager in writing.
By Jan 2022 I will have only accrued 1-2 days of holiday and perhaps 1-2 days carried over from my previous year. I wish to take some time off to visit family overseas post covid between jobs.
My job contract states that I accure holiday on a Pro Rata basis and the holiday period runs between Jan 1st - Dec 31st however our HR platform allows us to book the whole of this allowance off in our HR management tool at the start of the year for approval by our manager.
My notice period is 2 months. Our discretionary sales bonus for the last 2 years is due to be paid out on the 28th of November. It seems that if people resign prior to this being issued that the discretionary bonus is not paid out.
If I resign on Nov 29th what is most likely to happen?
1: I am allowed to take my holiday as this has been preapproved but the unaccured vacation days are essentially unpaid leave and my final paycheck is lower.
2: My current employer forces me to cancel my planned and approved vacation following handing in my notice as this is unaccured vacation, are they able to do this?
