B Permit - Geneva (Canadian Married to Swiss in Geneva)

I'm preeminently writing that I have extensively researched with the Search function before posting this, but would like some personalized answers if possible - Thank you

So back story is, I am a Canadian citizen and I got married in January to my Swiss (now wife) I at the geneva civil office.

I did not apply for the type D Visa since I'm currently not living in Canada but in a different non -EU country ( I'm dual citizen), and the office for my country for Swizterland is in Ukraine, so not really a place I wish to go to these days.

I came here on the tourist visa and applied for the B permit at OCPM, and having spoken to friends here that are American and married swiss nationals, were able to to this all on their tourist visa, including getting their B permit.

My question is, knowing all the details about the purpose of the D type visa, and the waiting times for B Permit,

1) can I stay here over my tourist visa until my permit gets approved and not leave the country until that day without any repercussions?

2) is it possible to get an attestation for OCPM while my application is in the stage of "A L'examen"?. I have some time left in my tourist visa, so I could leave to my "birth country" and wait there until they process it finally before coming back to do my biometrics if they approve it and at the same time ask for them to direct my visa stamp in FR or DE?

3) Are the likelihood chances that I will have to go back to Canada? which I don't particularly wish to considering the communist regime currently in power there.

Additional info as to why I didn't just register the marriage as my birth country but instead Canadian, and the answer is because I'd need a visa to enter with the other passport, and its a higher chance they would treat my marriage with my wife as sham since its an easter European country.

As you have an application in for a family reunification permit you can stay until you get an answer.

Moldova? Don't they enjoy visa free regime since ever? Anyway, if you already married you are fine, you dont have to return anywhere. At this point while your B permit is in process of approval, your tourist visa is irrelevant. Noone will send you to Canada for sure.

P.S.: communist Canada bla bla - i have bad news for you in Switzerland

Yes Moldova, but no, I have to apply for a Schengen visa since the 2021 law changes.

I think you might have misunderstood something. I just checked, nothing has changed for Moldova in 2021. Apparently, some EU countries pushed for reimposing visa regime, however, unsuccessfully. Here is the link:

For tourist purposes you still dont need a visa. Also, Swiss embassy in Kiev never accepted tourist visa applications from citizens of Moldova, only those over 90 days (national visas not Schengen).

A communist regime in Canada... Yikes. If the current government in Canada makes it a place you don't want to go, you must not be getting out often.

That's for the tourist visa though. In principle that doesn't affect the need for a Visa D to initiate a move to Switzerland or a long stay. There might be other expemptions at play here, but not requiring a visa to come as a tourist doesn't automatically need you're not supposed to apply for one in the case of family reunification.

But most likely you're fine with staying. I'd still check with the migration office to have some kind of paper that says you have a permit application in process and ask them to confirm that you don't have to leave at the end of your 90 days if the application is still in process then.
