To give an update - we received a letter from the military today saying that we don't need to pay more (well, just a very small amount more).The total amount we will pay will be probably less than half of what we were brought in for on the Betreibung.

The government addmitted an error, and even corrected it after we gave in and started to pay them. Knock me over with a feather.

But kudos to these people in the military office for doing the right thing and straightening this mess out after we finally just agreed to pay, and having any black marks removed from my husband's name.

Sorry for not answering this earlier but I have been busy and these days there are so many posts ones go easily unanswered...

You are right when you say the other party agrees to its removal. This is the key point as unless it is the government this is often a rather lengthy effort to get agreement and sometimes the answer is simply no. You cannot get a court to force the other party to agree unless there has been a mistake somewhere... So you can left stuck with it

As I said before somewhere each Betreibung is allocated a unique number and this numbered list is what the banks get to see - which of course has no gaps... Apparently they need to be able to have this to calculate risk...

The dumb part is that, as in my case, they do not see that the Betreibungs have never come to a conclusion - each time I have taken the legal option and the outcome has been in my favour...

Yes I find it silly that after doing the initial paperwork I have to provide the Betreibung thing and proof of no criminal record. Don't government agencies interact with each other?

Say if I was applying for citizenship then after I submit all the forms it should be the job of the govt. to check my criminal record etc by contacting the relevant agencies instead of me having to do the leg work

I was fined CHF80 for an honest mistake by the ticket checking Nazis. I paid it on the spot but how long will this black mark stay on my record?

Don't worry, all fines up to 250 Fr. and some of of the higher ones are "Ordnungsbussen" / "Amendes administratives" and won't make it on your criminal record.

Regarding where to get the Betreibung Auszug, can you just show up at the Gemeinde even before being officially domiciled there ? I'm still officially paid and domiciled in London but will be in Zurich earlier to find a flat.

In other words, is there any link between those two offices or do they just look for your name and if they find nothing they just give you a blank extract?

Sunrise, Orange... it seems that all phone companies and ISPs nowadays simply use debt collection agencies and/or the courts as a first method of attack should you dare to have a dispute with them.

As a good Swiss friend wrote when I got my first Betreibung:

"The apartment owner didn't want to give you the flat even if the Betreibung was from an ISP? Would have thought that they know that ISPs are "special"..."

Does anyone know the difference between the credit history kept at the Gemeinde and that kept by the ZEK (Verein zur Führung einer Zentralstelle für Kreditinformation)?

From where should one obtain their credit history? I'm a bit confused ...

Yes you are, so long as the fee ( CHF17 I think ) is paid - you might get it instantly.

In a nutshell, the ZEK is where credit is registered..loans, car leases, etc. This helps banks, etc determine if you are over commited or not.

The Betreibungsauszug (Gemeinde) is your bad history...if you've failed to pay your bills or defaulted on debt. You DO NOT want an entry here.

If it helps anyone (in Basel at least) I recently applied for an apartment and had to get a Betreibungsauszuges thingy. I'm in Basel Stadt so I basically walked into their office below which opens at 7.30..got in before work which is well handy. It cost 17 chuffs and even though I only got here in August I still had to have it for the apartment application. I've since scanned it and have an electronic copy of it now.

It's a good idea to scan it in. However, some leasing agencies require an original. In Bern they'll copy the form and sign it again for 7 chf per copy.m

I've read through many of the Betreibungsauszug related threads here but I'm now wondering if there is my situation complicates things or if there is a smart strategy I can take here -

Me and my partner are searching for an apartment, she has swiss nationality and has just started a job. I have EU nationality but I am still job hunting, so the gemeinde are treating me as a tourist until my first 3 months are up.

For my partner to apply for an apartment would be simple I figure, but it may be clearly strange or unacceptable to leave me off the forms. Thoughts?

For me to apply with her, might also be strange as I would have to indicate unemployed, and I think I cannot yet get a Betreibungsauszug for myself (Assuming we both need one).

Any thoughts on that, before I use my very rough german to try and communicate with the somewhat isolated gemeinde staff out here in the countryside where we are staying?

You may check with the kanton itself, rather than your gemeinde, especially if it's "isolated". For example, in Bern, you go to a centralized location for the form (I know there's an oberland and a mittleland office).

I know that if you live here, and have a permit, are registered, etc...you will generate a betriebungsauskunft regardless of employment status (the idea being you can still accumulate debt). I don't work and I had to produce one when we recently applied for an apartment.

If you're considered a tourist though, and you're not registered in the gemeinde (are you?), then I don't know how you can get the betriebungsauskunft. Is it possible for your partner to rent the apartment and add you to the lease later?

My girlfriend's Aunt has provided occasional swiss-german to german translation for me and helped us at the gemeinde - and combined with what I have absorbed from the forums here confirms somewhat that as an EU jobseeker, I have registered, but not got a permit as none is required. (after 3 months jobseeking I can automatically get the L-permit I guess, and presumably renew it til I find something)

But it doesn't entirely make sense, and maybe this small village gemeinde only have one person like me per decade so they don't do it a lot - they are waiting for me to provide my krankenkasse policy number, and the insurance companies are asking for my permit details, which I of course dont have. Atupri insurance at least have said they can sign me up without it.

I will see how far we can get with only my girlfriend's Betriebungsauszug, or visit the gemeinde again perhaps with some explanation of why its necessary even though it is obviously going to be blank - then they might be able to create one for me.

Well, my kickass auntie-inlaw-but-not-yet spoke to somebody at the local Oktoberfest on Saturday night, called up on Monday for us, and they delivered our Betreibungsauszug with extra copies, for my girlfriend and I, on Tuesday.

Yes, as long as you were registered when you lived here you need to request it from where you lived. The document will cover the period when you lived there.
