Breaking-up - who gets the appartment?

What is an 'OP'?? I've seen that here before and each time I think it's meant as 'OAP' (old age pensioner) but that doesnt seem to fit here!

Sounds like a joint & several obligation so you probably shouldnt leave and certainly not take on a new commitment until this one is terminated (I mean new flat, not new gf).

for people pointing the finger at the bloke and telling him 'buck up you're a man' well, we don't know, perhaps she did the dirty on him or out earns him significantly. Anyway in these cases probably best to stick to the legal facts as only one side of the emotional story is presented!

O riginal P oster.

I do not mean here to stir up the gender fight in terms who should do and what??? This might as well be negotiated in diplomatic manner between both partners. It is just my own insight from my "ego" point of view!

After she is done doing your laundry, I would tell her to get into the kitchen and cook you a steak! After that she should move out. Good luck getting out of this situation.

Isn't it 'now go cook some eggs!' ??

or is that just in NZ where wife/gf beating is national sport?

On topic please...

Actually the final paragraph of the linked text says that it is possible if all parties agree :

Which implies that you need approval in writing whether it is on the contract or not. But it is not possible to give notice without approval of all those on the contract.

In fact it goes a bit further than that if the apartment was a family home. Although only one spouse can sign the contract and the contract need only have one name on it, both spouses MUST sign the termination letter for it to be valid.
