Court order to unlock an Apple ld phone

Hello everybody,

Does anybody know which Court in Switzerland you would go to get a Court order to unlock a dead relatives Apple ld phone? Or do we go to a lawyer? Is it the Besirksgericht Winterthur (where l live)? Apple company is requesting the Court Order.

Thanks for your time

Did you contact Apple Support?

What did they say?

OP said that Apple is requesting a court order.

I think you'd need a lawyer for this. But if it's straightforward and you have the genuine right to access the data it should not be very expensive.

One other thing you could try, is if the relatives phone was linked to their computer, it may be possible to get in via iTunes.

Recent versions of iOS allow for setting this up while there's still access to the device:

I also wanted to say "get a lawyer" - but reading this page:

https://support.apple.com/en-us/HT208510

I now believe they will accept any court, even a local one.

It would need to be addressed to the Irish subsidiary.

In principle you would either need

a certificate for disclosure:

https://www.gerichte-zh.ch/themen/er...-auskunft.html

or

a certificate of inheritance:

https://www.ch.ch/de/ausweise-und-dokumente/erbschein/

And the competent authority would be at the residence of the deceased. Please note that in requesting a certificate of inheritance means that you accept the inheritance (even if it is over-indebted).

Reading this, Apple might possibly ask for additional documentation, since the certificate of inheritance or disclosure is not actually "addressed" to a specific party:

P.M. if you want to have a lawyer assist...

Thank you all do much for the replies. Yes, we have the certificate of inheritance (Erbschein) and Death certificate.

Thank you again.

Would like to private message you Mica

Out of interest, how does one NOT allow relatives to have access to their phone after they're gone ?

Now there's an idea. An app that, if you don't access your phone within a month, does a factory reset.

Write it into your will.

That the last moment is near is not always predictable; known illness, ageing very different than sudden death in an accident, a fall, stroke, cardiac arrest.
