D Visa for Canadian son, non EU parent

Hello ,

I have been a super avid follower of english forums last 5-6 years but never had a chance to ask a Q (largely because the search and the community here are so vibrant that most of my Qs get addressed just by searching )

But here is a situation where i thought I need more eyes to see it right

We are non EU parents

and due to multiple project circumstances

we have B permit in Switzerland + Permanent Residence(PR) permits in Canada

We recently had a baby in canada so now he is a citizen there but we want to get him back to Switzerland as my project there is coming to close

This is what I gathered so far from my homework

1 - As a Canadian citizen he can enter Switzerland <90 Days without visa

2 - D Visas usually take 8-12 weeks roughly

3 - Can we as a family - Apply for the baby's D visa from canada ,

travel back to switzerland on the <90Day visa , wait for the D Visa to get approved and then may be step out of switzerland and re-enter ?

Are there any key points I am missing out in this process, what aspects am I oversimplifying /assuming

As you posted this after midnight, have a bump.

How long were you out of the country on the B permit? I think normally the Swiss would frown upon you having two residencies and that could (and I mean could, not will) make things a bit more complicated when trying to bring a newborn dependent.

I think people often "go home" to give birth, it's not mega unusual. I'd be surprised if the Swiss insisted on a D-visa for a baby of parents already resident. Call your gemeinde and ask what they'd like you to do, maybe they will waive the requirement.

If you mean the 181 days out of the country clause then we are within it

But if you mean the frown because we have 2 country permits - I can imagine they not being happy but consulting projects in the past led us down this path.

One of the immigration lawyers I spoke to was baffled too, took half hour @ 350CHF an hour to talk him through the situation

Not something I could think of myself doing, Thank you for the suggestion, doing it right away

Also in the D-Visa application they only ask for passport copies/number.

Do they ask for the physical passport for stamping after the approval ?

Quick update

I called the Gemiende. They were super kind and helpful, they asked us to just come down directly and that we can apply from Switzerland and they will help fastrack the process if needed
