That happened to me, you need to appeal, however saying I don’t remember is a bad idea & not answering the questions is better as they need evidence of some sort unless you do nothing which is the same as agreeing. If he has legal insurance it’s time to contact the insurance.
I had some news from the hospital today that they’re letting him come home for half a day on Good Friday, plus he can come for an overnight stay Sat / Sun, so I’m mainly just thinking about that at the moment. He’s allowed to out of hospital for 23hrs and 45mins for the overnight stay.
One of the reasons for him being allowed out is he’s exhausted from listening to the patient who shouts and screams 24/7, when he’s in his room he’s wearing noise cancellation headphones all the time. The doctors have said once it’s possible to move him to a part of the hospital for patients who are not such high dependency it’ll be better as he’ll have more peace and privacy (i.e. no confused patients wandering into his room).
If the Police really have zero evidence, a lawyer ought to be able to come up with an explanation as to why he is innocent. This is why saying nothing is important & saying ‘I can’t remember’ allows the Police to come up with an explanation that makes him guilty. It’s a game only the Police know the rules better than you do, they are allowed to lie to you when they question you!
And “I don’t remember” sounds like it could be a totally valid, truthful response from someone who’s just had a bad head injury.
I don’t know if the assumption would be then that you lost control absent all other information.
Compared to “a car hit me but I don’t remember any details”.
Which they could turn that round to “I hit a car” and double any fine.
OH was moved from high dependency to another unit of the hospital last Friday. I thought this would be good for him as he was finding the patient who screamed day and night very distressing and he wasn’t sleeping, I was really pleased when he told me he was moving.
He has a lovely room with a balcony overlooking the animals and aviary, but it’s not working out at the moment and this week has been stressful as I’ve had a sore throat since Monday and can’t risk visiting (he’s still in semi isolation). It seems on this section patients are pretty much left to their own devices in their rooms and there’s not much communication with staff. He also has a less full daily schedule and today he got his morning meds 4 hours late, the epilepsy one makes him drowsy and he conked out in the afternoon (thankfully they’re gradually cutting the dose until he can come off it). He was also supposed to have a session with the lead doctor today and she didn’t turn up.
He’s also had conflicting info from different staff shifts, he was told he had to have his meals in the common room, then he was told he wasn’t permitted, then told that was wrong and that was ok. We were also told I had to do is laundry at home which was wrong. He now has a pass to get in and out, but was told off for taking a walk in the grounds yesterday evening. He doesn’t know what the rules are now and he doesn’t want to rock the boat in case they think he’s difficult.
I’ve been a bit concerned about his wellbeing this week as he’s been quite down, is complaining about a lot and is quite vocal about it.
We have a joint meeting with a neuropsychologist on Monday (rescheduled from last Monday due to my throat issue) so I’m deliberating whether to mention all this to her. Thankfully the overnight home weekend visits are working out which is good for both of us so that’s something. His accident insurance is also paying out the 80% of his salary now, but the agency in India keep emailing me about a restarting work date and I’ve had to be curt with them as they don’t seem to read the info I’m giving them about him still being an inpatient!
