Divorce/ Annulment - Chaotic Situation question

Hello,

earlier in the year (January) I got legally married to a swiss citizen in geneva (im Canadian) and 1 week later we submitted the documentation of family reunification. Just over a month ago ( a month before the wedding) she broke off the engagement and the wedding and told me to leave right away, and she will deal with he divorce process/ lawyers etc.

I found out a few weeks ago that she sent a letter to the OCPM asking for an annulment rather than divorce on the grounds that I'm a psychopath and wanted to use her for getting my Swiss paper (all false accusation as I have never assaulted her, threatened her, or in anyway abused her (with mutual friends and witnesses to corroborate this), so thank goodness I'm out of this relationship).

My question is, if I plan on returning to switzerland on my own terms and my own permit as studying for a masters next year, will her false accusation prevent me from entering and pursuing my own life in Switzerland? Do I have any recourse?

I already have a network of friends and connections and enjoyed my time in Switzerland, so would like to live there if at all possible, of course without her in my life.

I read that as the former being the official notary witnessed wedding and the latter being the possibly church-based bells and whistles with a reception wedding.

Perhaps, but then they legally got married.

OP can contest any divorce or annulment, but probably still has to leave.

And word of advise, dont divulge any identifying information here or on other public boards. This also applies to your perceptions or assumptions.

This needs robust legal advise which none of us are capable of giving (or even should be giving on a public board).

Btw, long shot but do you have legal insurance? that may help.

If the annulment takes place based on the reason of you wanting Swiss papers - I highly doubt you have a single chance to come back here. Her reasons are clear, she is afraid to now be financially responsible for you, especially if you did not enter Swiss workforce. Get a lawyer and divorce. And even better - communicate with each other, find common ground and come to an agreement.

If the authorities thing they're not false, then yes.

Im no longer in the country, I left over a month ago, and have no legal insurance or the funds to hire a swiss lawyer for that matter.

She doesn't respond to my texts or any calls.

Then it will be tricky.

In absence of legal representation, your case will be weak.

Did you deregister and hanged in your residence permit? I would reach out to authorities and explicitly let them know your whereabouts.

My b permit was in process, I never got any permit or legal status.

I'm not sure if you are entitled to any local legal support, but since the case is in Switzerland, perhaps you are.

If you are, I would try to negotiate that the annulment would be allowed, but to take away the current reason. Why would she do this? To ensure you don't come back to Switzerland?

My friend has a lawyer friend that said I could reference him and request a government subsidy in this situation, not sure if it is possible thought.

on the topic of why she's doing this, yes im assuming its to prevent me from every coming to switzerland, as her behaviour has been very erratic and unpredictable since the day she kicked me out of her place.

No, im not sure how to do that if I never had a legal residence or address there, as I was there on tourist visa.

If you’d applied for a permit, you have registered (even if you were still waiting for it to come through) - you should have told them you were leaving the country.

You should have gone in in person. You’d better phone them. Do you speak French? Have you been paying health insurance?
