Good evening,
my husband (German) is working in Switzerland and I want to vist him for a month. I understand that as a german citizen I can stay for up to 90 days without a visa. If I stay for one month, but I also want to continue working as a freelancer ( no Swiss firm involved) do I still have to register somewhere?
Since I won't be staying longer than 183 days this year, I know that I will have to pay taxes in Germany.
Thank you.
As a tourist, yes. Working, no.
You mean, if I want to continue working I cannot stay for 30 days even if I am not working for a Swiss company?.
Work is work, whether for a Swiss company or not, paid or unpaid... I think you’d be very unfortunate to get caught but if you did the burden of proof is on you to show you were only on holidays. You can watch some of the many border security videos on YouTube to get an idea of what not to have in your possession should you get caught.
Any income deriving from work you physically do within Switzerland is taxable in Switzerland. The 183 days (along with other rules that reduce that further) concern whether your worldwide income is taxable in Switzerland.
Since you presumably will be working remotely using a laptop and phone, I doubt anyone will be able to find out. Since probably the tax due will be less than the cost of processing it, I doubt anyone will want to find out. It's just not worth the authority's while.
Means if you want to continue working you shouldn’t visit at all. You are not allowed to work in Switzerland, full stop. You can visit as a tourist, but tourists don’t work; they go to museums, tourist spots, hiking, etc, but they don’t work .
Is your work really that important/necessary that you can’t take the time off?
As others have said you might not get caught. But then again, there’s no guarantee you won’t either. It’s up to you whether you want to risk it or not.
