My British husband and I arrived in 2017 and so we have EU B permits. He is the main holder and mine is family reunification. My husband has recently lost his job and we’re just a few months away from renewal. He has some interviews lined up but obviously nothing is guaranteed.
As I also work, would it be possible to make me the main permit holder? I am assuming as we have pre Brexit rights this is a possibility without my work needing to prove there are no Swiss/EU candidates? If so, is that something I should do now or do we have to wait until renewal? I am currently waiting for the results of my A2 exam so I could potentially apply for a C permit soon.
I am quite concerned about our situation as we have made a life here and had no plans to leave yet.
I don't see why you'd need to switch the main permit holder since you're both EU. I believe that since you entered CH pre-Brexit you're grandfathered in under the old permit system. Being on unemployment doesn't automatically disqualify you from C permit, at least if you believe what you read on EF.
