I am hoping someone can help with my particular situation:
I am a non-Eu citizen and permanent French citizen (spouse French citizen) living in the border zone with Basel for the last 7 years. I had G permit and worked in basel for 5 years. After a break, I now have a job offer in Zurich and have to do the work permit application myself. I am reading some contradictory opinions about non EU nationals. Does anyone knows if I will be subject to the quota?
Alternatively, as an auto entreprenor in France, could I service clients in Zurich?
Your insights are much appreciated.
G’s aren’t subject to quotas far as I know, but I would have thought the employer would still have to prove they can’t find a Swiss/EU national to do the job.
And far as I know again, no you can’t do work in Switzerland as an independent.

What does " permanent French citizen" mean? Do you actually mean "permanent French resident"?
Sorry, yes I meant permanent resident.
Any activity in Switzerland will require authorization from the competent authorities (link here for Geneva)
But that does not mean you cannot work as an independent, you just need to get permission.
As far as I know, G permits are not subject to quotas, based on the bilateral agreements with EU. But from what I have seen, it is your employer who should ask for the permit, not you.
The FMOP agreement does not apply to non-EU citizens which are EU residents. For non-EU citizens the old cross border agreements with the respective countries apply. As the Swiss-French border zone is 10km to either side of the border Zurich is not covered and a cross border permit is out of scope.
Is see only these possibilities:
- Move to Switzerland with the EU spouse.
- Move to the German border zone and wait another 6 months.
- Hope that the Swiss employer can get a permit secured, and than move to Switzerland alone.
- Your future employer opens an office within the border zone/Basel.
- Purely work remotely from France.
Thanks for your valuable inputs. As a non-EU case, I would have to live within a certain distance of the borders of the canton (not just swiss border as can be assumed by reading websites).The G-permit application in Zurich was not approved as the canton does not share a border with France.
