I heard from that a few of my colleagues (whom are non-EU from India, and US) that some companies are seeking Permit B pre-approval before offering them a contract to sign. Has this happened before? It seems these firms have some special power, or does this depend on the Canton?
It could rather be that they inform the prospective employee of the salary and terms of the contract prior to applying for the permit. But I can't imagine they'd present a contract to be signed before a permit is secured.
The job must be one that an EU/CH national cannot be found for it. This can be determined without a specific candidate in mind.
In a sense this is ‘pre-approval’ but the actual candidate still must be approved. The job could be offered on the condition that approval is forthcoming.
Non-EU contracts will likely contain a clause that says it’s subject to permit approval so even if signed if the permit is refused the contract will be null and void.
Permits are based on quotas, there were always some smart companies that negotiated to have a sub-quota allocated to them that they could use as they wished.
