The first one isn't a surprise, I've had a few gripes with them in a commercial capacity - suitability was an unknown concept to them!

It's both, as the makers of the product should be able to determine who can and who cannot sell it for them. If you deal with crooks you've got to be prepared to be taken for a crook yourself. Or do you think they are so blind as to be totally unaware of how the likes of the companies that may not be named are operating?

You're right in that the providers might have a moral responsibility there. Having said that, it's not really their bag, especially since the intermediaries (sellers) aren't actually doing anything illegal. Moreover, none of that means that the actual products are bad.
