Intra Company Transfer

Hi Members,

Asking for a friend, She is looking for an internal transfer from the Netherlands to Zurich. She is a Non-EU citizen. I read internal transfer doesn't require a labor market test.

Is there any other catch?

Thanks for your inputs

I was in the same situation, been on the company for a couple of year, but was still required to go through the non EU/EFTA process (job application, no suitable Swiss or EU applicants)..

I came from a non EU country, so not sure if that is any different.

that's incorrect

I do wonder why so many of my colleagues are from the subcontinent and work for the likes of Cognizant. Are there really no EU or Swiss people with similar skills?

In Switzerland, an intra-company transfer may be allowed under the GATS or under national legislation.

In both cases, the local market testing condition is not applicable.

Under the GATS, intra-company transfers of non-EU nationals are possible for executives and senior managers, as well as highly qualified specialists. The SEM considers that the executive and senior managers are the people whose essential task is to manage the company or one of its departments. They only answer to the company's board members or shareholders. In addition, highly qualified specialists are the people who are indispensable when providing a determined service by their specific knowledge and experience regarding services, research equipment, technical skills or firm management

Highly Qualified Specialist? Not Like a regular specialist who comes on L/ B permit ?

I'd take it as a new job instead of just a transfer . So, plan life around the three month trial period at the job. Do not get into a long-term rental contract, car leasing or any other form of consumer credit with institutions in CH during the trial period.

Look around EF, there are sob stories of people moving with the family, signing a multiyear home rental contract, only to find themselves a few weeks later with no job in CH. The reason to come here.

On top of what was said, ensure the contract has a clause to maintain years of seniority (Important for some benefits and eventually redundancy if it came to that) as well as a repatriation clause if the company fires you so that you are not left financing your move back.
