Is it legal for a Regie to only accept applicants with permit B or C?

Hi All,

We're moving out of our apartment in Lausanne and have sent 5-6 very well-paid applicants to our Regie to take over our lease. However, they are all on CDL permits (like we are), and our Regie has rejected all of them and said that they will only accept applicants with a B or C permit. Is this legal? It seems like bullshit as we're on CDLs and have been renting.

If what they're asking is illegal, it would be great to know what to do about it.

Indeed, something smells fishy, but I don't think it's "illegal".

You did the job of finding replacement tenants. The landlord is entitled to reject replacements tenants for whatever reason. However, if 1 of the replacement tenants is OK financially and suitable for the apartment and anyway the landlord rejects this person, you are free from the contract.

Hopefully all the communication with landlord is in written form. If not start using registered mail since now. If you're sure at least one of the replacement tenants was suitable, you may ask the landlord a release from the contract.

Totally legal. They could instead just accept and not to select you without telling you anything. At least they are straight forward.

While a regie or a landlord shouldn’t care, a cdl will contribute nothing in tax revenues but will cost the commune for things like bus subsidies, rubbish collection, etc. I doubt there is a push to exclude cdls but ....

The regie can deny anyone. However, as you have a CdL they are viable and acceptable replacement tenants, which releases you from your obligations accordingly Art. 264 Code of Obligations .
