It appears that you may have used your actual name as your forum name. If so, I would strongly recommend talking to the company before they read it on the internet. But even if not so: Openness is the best solution, anyway.

And you never know: Maybe they had another candidate who was almost as good as you and whom they can get now but not in a few months' time. So, you may even make someone else happy.

I would choose Switzerland over Germany any day. There is a reason why Germans are coming here in droves!

That was because of the stagnant economy in Germany until recently.

Now it's taking off, however, so I'd assume less Germans coming to work in Switzerland.

It is OK to ask about the local rules - I would not be worried over them finding it out on Internet. It just shows that you are thinking through before reacting - never wrong.

They saw who you are on the interview and since they offered you a job they obviously like you. So do it in line with who you are – in line with your personality. In that way you are on the safe ground - no regret that it should be better if you did it in the other way and I am sure that, even if they get upset, they will understand your decision.

They are aware that we are applying to different jobs at the same time. I noticed that some companies send me negative mail after 1-2 months. So it could indicate that they waited to be 100% sure that the person they picked will actually show up on the first day at work.

Hello to all and sorry my first post is such a boring one but....

Having read through the various threads I could not find advice relating to this subject. I am considering resigning from my current job but was wondering if anyone knows whether the date of resignation is viewed as the date on the formal letter of resignation or is the date of resignation the date on the letter plus the notice period?

Need to know so I don't get stung with re - paying relocation etc

I've resigned as per my last working day (including the notice period)

So if you have 1 month notice period and your last working day is 31st Jan. then you should hand your letter latest 31.12 and write on the letter that you quit as per 31st January.

I did like this and didn't have any trouble.

This site gives very good info on employment law.

Basically, you can only resign at the end of the month, and the date of receipt is the key date, so if you hand in your resignation 2nd Feb (and you're on 3 months notice), then the effective last day of work will be last working day of May. It doesn't matter if that day is on Friday or Monday.

I am planning to resign from my job in Basel - I have another role nearly in the bag, but am reluctant to resign before contracts are signed.

What do I need to do to resign in Basel - is a letter sufficient or is the face-to-face meeting necessary.

Also - I have a 2 month notice period but would like to get out within 5 weeks - is this realistic here?? (just want to be paid for the weeks I work, not any extra for notice)

How much holiday do you have remaining? I believe the employer cannot stop you taking the holiday but can state when you should take it.

If you are within your probation period you can resign at any time and not just at the end of the month...

A letter is sufficient but in that case hand it personally to HR not to your boss or send it registered. Anything else and it might get lost.

As to getting out early, that is down to your negotiation skills. It is often more difficult than you think and there is no way that you can force them to let you go early. Even holidays you are owed, if they were not already agreed and booked, can be cancelled and paid out instead.

So even though you want to hand in a letter, I would suggest you get ready to do some talking as well...

Thanks for the replies - unfortunately I owe the company holidays - back 3 weeks after a "contemplating life" break away from work - but will take unpaid for this. Nothing doing project wise at the moment, so hopefully they wont make an easy escape too difficult.

I just got a job and I'm still on my probation period, I discovered that the job I'm doing isn't as what I was expecting. Now I might have another opportunity which sounds very interesting, however it's not yet for certain,during the interview she said she likes me a lot and she thinks that I'm suitable for the job, only that she's not happy with my plan to go for a 3 weeks holiday which will fall during my probe Zeit. I have paid the tix and it's a non refundable one.

My question is how long the notice of resignation during probation period according to Swiss Law? I read my employment contract and it's only written that resignation and termination during probation period is as per Swiss law...

My probation/trial period is three months. I work for a university hospital so I assume they make their contracts according to Swiss law.

I find writing "as per swiss law" is very vage. I think it should be clear in the contract how long the trial period is and when you are allowed to resign within this period. My contract has all that clearly written in it.

During Probitzeit, your termination period defaults to 1 week under Swiss law.

The contract should state the notice period as well, which is 1 week (during trial period only).
