Lost luggage - timelines for return

Don't want to open a new thread, using this one to describe my case and maybe someone knows what are my options.

Mid August, I had a planned flight with Edelweiss, my luggage never arrived at the destination. I stayed for about a week there, nothing arrived. I had to purchase clothes, underwear, toiletries, it was a disaster, especially since my holidays was only 5 days. Upon my return, before leaving the airport, I went to the Lost and Found, they told me that Swissport could not find my luggage as well (!!!) and since 5 days had passed from the flight, the responsibility lies with Edelweiss and not Swissport. So naturally, I call Edelweiss to try to figure it out.

Edelweiss call centre is completely incompetent. They do not want to help, they have a playbook and keep repeating the same things. They told me that the ONLY option I have is to fill out the online form and this will initiate an e-mail correspondence. There is no way to talk to somebody on the Lost and Found Department on the phone, everything is done via a form. They also told me that it is not their responsibility but the responsibility of Swissport. So the typical blame game had started.

Not knowing what to do, I created two claims, one with Swissport and another one with Edelweiss, asking for compensation for 2 things:

1) Value of the items lost (Swissport and Edelweiss)

2) Compensation for expenses incurred as I did not have my luggage. (Edelweiss only)

In less than 24 hours, Swissport called me to say that they had found the luggage, they sent it at home. I was happy for that, so I replied to the confirmation mail of my Edelweiss claim, saying that the bag is found and that I only expect compensation for the expenses incured. This was almost 2 months ago. One month passed and I sent a reminder. No reply again.

I try to call their incompetent call centre and the lady there that was speaking broken English initially told me that she couldn't find my claim. She repeated that the claim is not on their system and I have to send a new claim, even though I told here the claim number multiple times. I agreed to do this again, and asked for a physical address, to send a registered letter in case my new claim remains unanswered for a week. She refused to give this to me, by saying that the only option is to create a new claim. I was furious, because she could not even understand the concept of the registered letter, as a means of having proof that you make a demand that needs to be answered within a timeframe. I asked to talk to her superior, I asked her if she works for Edelweiss, I even told her that since she is an Edelweiss employee as she claims, she definitely knows the address of her employer. She was constantly muting herself, it was clear that she was online with others trying to help her, and she was always coming back with the same bullshit scripted suggestions. At one point, after about 50 minutes being on the phone, she said that they found my claim and they will respond to me. At that point, I did not care, I insisted on the address and tried to explain her what a registered letter is and why I needed to know where to send it. She obviously played dumb, and I got really annoyed because at that moment I had spent 1h on the phone.

So as this whole thing has escalated, can somebody recommend next steps? Obviously, my legal insurance would want to have an official registered letter sent to them, the stupid online forms mean nothing. I found this address, do you know if registered letters can be delivered to PO Boxes?

I’ve been waiting for a response from Edelweiss about a claim for over four weeks. I’m certain they will get to it, but I’m not in a rush.

Wow, this is actually very helpful, never thought of sending a registered letter to the CEO of the company... Lets see if this helps...

Edit. Before I even post my reply, there is also another helpful answer, thank you both!

In my experience, sharing this on Twitter or so helps as well.

So here is an update.

I sent a registered letter to the CEO and the luggage department of Edelweiss. I stated facts: dates, communications, reports with reference numbers, telephone calls with duration, list of purchased items, copies of receipts, etc. I told them that I expect an answer, or at least a reply acknowledging the incident by the end of October.

Here we are at the end of October, no reply from them at all. What are my options now? I am not a social media person, so Twitter, Facebook, etc., I will not do. I am not a fan of sharing personal info just to 'force' a company to give me a few hundred bucks in order to avoid bad publicity.

Is there any organization where I could report the incident? The behaviour of the company is unbelievable, they are treating their customers as if they are a low cost carrier, but of course they charge insane amounts of money, never gonna fly Edelweiss again... At this stage, I do not care about the money, it is a matter of principle.

Never, never, never say you will never fly with them again. Even if you don’t.

In their eyes you change from a pissed-off potential future client to a lost cause.

Much better to say how disappointed you are and you are looking for reasons why you should trust them again in the future.

Under the Montreal Convention 1999 (MC99), which has been ratified by Switzerland, the airlines agree to waive liability, meaning you don’t have to prove your loss. But in exchange your Compensation is limited to a maximum SDR1221 (about CHF1500) per piece.

Detail your claim and send them an invoice.

Ok, this is clear. I have all the documents, receipts, etc. I have already sent them to the airline by registered letter and they ignored me. If I send an invoice, they will ignore me again, right? I mean, they have been ignoring me for 3 months now, nothing stops them from ignoring me once more...

Do they not have an online claims system where you can just provide the details and the amount of the claim ?

Did you try your travel insurance ? We have a yearly travel insurance that is quite cheap and to be honest I don't even know exactly what is covered for luggage, but we use one of the big Swiss companies for our insurances, and they were extremely helpful a few years ago when my son got sick overnight and we literally had to cancel our travel plans 4 hours before we were due at the airport, and go back to bed....

As I said, it is not about the money, it is a matter of principle. Insurance covers this, although it was uncertain until a few days ago. But it really amazes me how they can completely ignore people to whom they have caused damage and to whom they are liable.

And yes, they have an online form, or better an e-mail address where you can send more info to the them and then you never hear back. Anyway, I think there is no point in fighting this anymore, it is a lost cause.

I believe there is one thing you could still try. I know it from my home country, so I won't give you the exact name of the governmental office but it should be sth like Swiss "Office of Competition and Consumer Protection".

So, you write e-mail to that office explaining your case with all the forwarded correspondence for Edelweiss and you put Edelweiss e-mail address to the CC of that correspondence.

Could liven up these bastards a bit

I'm holding thumbs. It also makes me always boiling when someone is ignoring his own (and so obvious) responsibility.

And it's not about being vengeful. You're their client and you gave them your money and trust. Don't let them walk away, otherwise they will not change for the better.

I seriously doubt they are ignoring you. Given the unprecedented problems with staffing at the airline, handling companies and airports they likely have an unprecedented deluge in reports and claims. They probably working through them as quickly as they can.

WK is basically a point-to-point airline. It does not offer on-line connections, and has limited interline services, mostly with LX. As a result it’s baggage claim personal normally is likely only a couple of people. Their ability to draft knowledgeable people in from other departments is very limited as is hiring temporary staff.

At the bottom of this page https://www.bazl.admin.ch/bazl/en/ho…t.html#contact are contacts for the Federal Office for Civil Aviation FOCA. You want the passenger rights people. Call them and they perhaps will be able to advise you.

Edited to add. I just saw excad’s post. Aviation consumer matters are handled by FOCA. Consumer people would just refer you to FOCA.

Did you contact them by registered letter?

Do you have legal insurance?

Tom

Yes and yes.

I don't think that legal insurance will bother for a few hundred bucks and I don't want to raise a claim. In any case, my travel insurance stepped in recently.

As I said, it is a matter of principle, they are behaving towards a customer in an unprofessional way, even though they are clearly at fault. But the more I look at it, the more it seems like a lost cause. They will either continue ignoring me or they will reply in half a year, if they are overloaded as bowlie said..

In any case, maybe I can report the incident to FOCA and that's it, no need to spend time on this.

I know you said that you prefer to not use social media, but I can tell you from first hand experience that it works. I tweeted to both Lenovo and Sonos about issues I was having with their products and in both instances I was contacted by an agent on private messaging, and everything resolved.

Adding to this thread as it seems there is a serious backlog with 'lost' luggage at zurich airport right now.

Our guest flew from Italy to Zurich - with a very short transit in Rome due to late arrival of the incoming flight - so their luggage did not make it to Zurich. They have an airtag in their bag. The bag was clearly moved from Rome to Zurich yesterday. It's on the tarmac somewhere at Zurich airport.

Buuuuut......

Swissport (Zurich) said on arrival they have a 3-4 day backlog to find and courier the bag to the owner.....

Now, two days later....they say the backlog is 10-14 days!!!

meanwhile, our guest is having fun working out what they can purchase with the allowed insurance.... and wondering how on earth the bag will get back to them as they are leaving Switzerland on Sunday....

Surely, the longer the backlog the more complex it gets for them to get the bag back to the right owner ? I have a feeling they would clearly prioritise - new bags - today's lots bags - yesterday's lost bags - and once your bag is in the 'insurance covers it' category they have little incentive to return your bag ?

Airlines are required to compensate passengers for reasonable, verifiable, and actual incidental expenses that they may incur while their bags are delayed. Keep receipts.

For most INTERNATIONAL flights, a treaty called the Montreal Convention applies to the carriage of baggage. The maximum baggage liability for flights covered by the Montreal Convention is currently 1,288 Special Drawing Rights (approximately $1,700.00 US) per passenger. This is the most that airlines must pay a passenger for a lost, damaged, or delayed bag. Airlines are free to pay more than the limit, but are not required to do so.

It is the airlines interest to locate the bags as quickly as possible.

Air Canada lost my bag - flight Toronto-Zürich 29th June. Bag turned up nine days later. No luck with Air Canada (after phone calls, on-line system), so I wrote an email to Star Alliance. Have received a case number and am now waiting..............

Maybe one of them can stay in Switzerland and wait for the bag?

Don’t give up. Send them registered letters, threaten small claims court. Get some media involved- they love bashing the airlines
