Non EU, B permit holder married to Irish in Canton Solothurn.

Hi Everyone,

I have been getting mixed information regarding early C- PERMIT in canton Solothurn. I am a Non-EU married to an Irish, and we have 5-year B permits.

I have been working legally for 2 years now.

My question are :

1. Will my ECAP language school certificate be recognized as proof when applying for a C permit?

2. Are Irish citizens automatically entitled to C - permit after living and working in Switzerland for 5 yrs without interruption? Because recently found Ireland has been listed alongside Germany, Italy, France, Austrian, and Spain. for C permit but not clear.

3. Am I entitled to a C permit once my wife is granted?

4. Does receiving Unemployement benefit affect ones Permit application?

Thanks

  1. You can find a list of accepted language certificates on the website here . If yours isn’t listed, then you need to get another one (I don’t see yours listed).

  2. Not automatically entitled, but you can request one based on FNIA Art. 34 paragraph 2.a, so long as there are no grounds for revocation and you are integrated i.e. speak the language. As long as you haven’t been a student during those 5 years - because then it becomes complicated.

  3. FNIA Art. 43 paragraph 5.:
After she holds the C permit for 5 years, yes you can have a C permit through her. Not before.

  4. No it does not.

HI, I also studied until B1 in ECAP.

What certificate are you talking about? A document telling Mr. Oajibare took a course with us from dd.mm to dd.mm.yyyy comprising 60 hours and he has B1. This document is included in course fee.

Or did you took the fide-test at ECAP? This is the one accepted by cantonal authorities (mündliche und schriftliche Prüfung) and it costs 250 CHF
