Non-EU: change from B-permit (tied to employer) to marriage with EU-national

Dear all

I've worked a few years in Switzerland on a B Permit that is tied to the employer and I lost my job a few months ago. I will marry a EU national before my permit is due for renewal. What process will I have to follow so the renewal of my permit is tied to my partner? Which effect would it have on the unemployment benefits I currently receive? I could not find any specific information online for this case.

Would need to apply for a family reunification permit and your spouse will have to show that the accommodation is big enough for both of you and that they can financially support you since you’ll be their dependent. It shouldn’t have any effect on your unemployment.

No I have a B-Permit that is still valid.

I assume RAV have taken over your current permit as otherwise, no matter how long you have on the permit, once the tied job ends so does the permit.

No, you can’t. Your spouse/partner will have to apply for it once you’re married.

If it's tied to your employer, it is no longer valid!

That’s what I always understood, having had such a permit. But it appears the OP has successfully claimed unemployment insurance. So I’m not certain.

I’m guessing his ‘employment’ continues until the RAV runs out.

No you don‘t. It expired the day you stopped working.

But having paid into RAV, one should have the ability to collect it while looking for another job.

If they don’t qualify for RAV they shouldn’t have to pay into it. But they do.

But then again if they get a C permit after 10 years they wouldn’t be eligible for RAV if they hadn’t paid into it.

From what I’ve read here on the forum, RAV can take over a permit, but it depends if they think you have a good chance of getting another job here fairly quickly. How well that works, if at all, with tied B permits I don’t know.

The B permit doesn’t invalidate itself the moment you lose your job. It has an expiry date and unless you’ve received a letter stating that your permit is invalid, the permit still holds up to the expiry date.

The canton can revoke the permit and notify you by mail. I don’t know how likely this scenario.
