Non-EU citizens: obtaining work and residence permits in Lucerne

Dear all,

Can you please advise me if it is possible to obtain a work permit for me, a non-EU citizen, who will be employed by a newly-established Representative office (RO) of a foreign company in Switzerland?

A foreign company is planning to establish its RO in Switzerland, and wants to appoint me as the Head of RO.

Besides myself, one Swiss citizen will be employed in the RO, and a Swiss company will be hired to perform administrative and taxation work.

I would highly appreciate if you can provide links to the legislation if it is possible or not.

Not knowing where a Representative Office fits into the scheme of things, i.e. is it like an NGO or not, I assume it would fall under the same rules as any other Swiss company wanting to hire a non-EU national. They have to prove they can’t find a Swiss/EU national to do the job.

You cannot apply for a permit as non-EU. The company hiring you must do so following the criteria MF posted above.
