Hi EF!
I have searched around and haven't really found any one in the same situation as me. I read this https://www.englishforum.ch/permits-...onsampt-2.html but it doesn't really apply.
My situation is that I am non-EU and my company only issues 1 year 'renewable' contracts and so I have had an L permit, and I just renewed for the second year (once this one finishes, I'll be at 24 months on L).
In ZH especially, I read that you 'need' to go to B after 2 years on L, but it is subject to applying to the AWA again to reinforce the need for a non-EU person, etc. However, if I do not get a permanent contract, I don't see how this is possible...
Am I right in thinking that it'll all be over next year, even if my company applies to have me 'renewed'? I haven't reached out to HR at my company yet - they weren't that helpful in the first place...
TIA
Ok, if you have a short-term contract, your permit is only valid for the period of the contract.
If you do, indeed, have a 1 year contract, then your L permit is being renewed each year as well, as a new process...
No, I have no idea if your employer will choose to renew your contract again - but they have to prove anyway, that they cannot find anyone to do your job.
I would personally be very insecure working for somewhere that renews employment contracts annually - is this typical ? Is this legal ?
Based only on anecdotal experience, if you're working for an Indian based IT company, there have been lots of those over the past year on the forum who are brought in for 1, 2, years, and are sent home again when their contracts run out, without getting permanency in Switzerland.
How far ahead of time does the employer need to inform you that they are renewing your contract ? Usually they need to put the forms in between 3-6 months ahead of the expiry date to apply for the new permit.
Indeed, there is a high level of insecurity in the 'renewable' set up. The company is not an Indian company, in fact it is a Swiss educational center - they themselves are not a permanently funded center and this flows down to the employees.
Most of the people at the company are Swiss/EU/have Swiss/EU spouses and so thus do not feel insecure.
For the first renewal (months 13-24) they were quite quick in doing it, I got approvals by the start of August for a contract end-date of the end of September. However, I'm really not sure how it's going to go the second time around. My manager and I are going for a promotion in the mean time (ha ha...) but I know that it might fall down like a tower of cards when it comes to crunch time.
