Non EU Restricted B Permit Renewal after 3 years

Dear All,

I have a non-EU Indian passport and was given a B permit which is restricted, the labor authority initially issued it for 36 months ending in August 2023,

I am due for renewal in May and I have a full-time position with an unlimited contract (Work in IT Data Analytics) , I have to prepare my own documents as my company doesn't have a dedicated HR

Anyone who has knowledge of what happens after three years on a restricted B permit,

will it get Automatically converted to an unlimited open B permit? or should it be specifically requested by the employer?

Anyone recently has experienced this or has knowledge on this subject, please share your thoughts, thanks much

Not recent but my employer always dealt with the renewal of my tied B permits. I handled the application and renewals of my C

Far as I know the employer has to show they still can’t find a Swiss/EU national to do the job before your permit could be renewed.

thanks and if my employer does the all the paperwork, my question is after 3 years in a restricted B permit do I have a chance to get an unrestricted B permit that allows me to work with any company without time-limit like I had the first time that was valid for 36 months

That is difficult to say. I would recommend talking to the people in your commune which issued the permit. Obviously your employer won’t want to secure you an unlimited B. You may have to wait until you are eligible for your C.

It can in some cases be in the employer's best interest to have the permit be open, as it also facilitates mobility within the company/structure, not just change of employer.

I don't believe it is true that the employer needs to readvertise the position and prove again that they couldn't find someone. We're in the process of moving from 2-year L to B (permanent contract from day 1, we have L because cantonal policy makes 24 consecutive months of L a prerequisite for B), and the work authorities specifically told us that the employer does need to present a full application dossier with motivation and justification like for the initial permit (and unlike a renewal), except they don't need to reopen the position, rather only show again that it had been properly advertised before the initial hire, and that the employee has since then fulfilled all expectations. And that's technically for a new permit. I can't imagine it would not be needed for us but be needed to merely renew a B.

So I have finally applied for my B permit renewal. I used form B2 fromZug canton.

Within form B2 I only used page 4 rest or not needed for renewal.

Along with form B2 (page 4 only) I was asked to send

signed contract

job profile and major responsibilities,

justification for the extension of the permit.

That is why the renewal paperwork has a place for the company to sign.

Hello,

I am alors on a restricted B permit for 24 months. From what I understood on this thread after the 24 months does your employer need to provide they still need you ? Is this what you meant by Job profile and responsibilities ? I had asked the commune and they said after the 24 months of still with the same employer some documents would be needed but not sure what. Did you need to ask your company to file some sort of procedure ?
