If I ask to have my Rahmenfrist start in January 2023, my contributions will be taken into account the 12 months prior to this date (Jan 2022-December 2022)? My employment contract will end before January (December 1), yet I am still on sick leave and most likely won't be 100% before January. I think my contributions are only counted if I was under employment (even while sick). Is this correct?
Everyone is so helpful here. I spoke with UNIA and will speak with RAV next week. Both have been helpful. To aid in my thought process:
Your entire salary counts, sick or not.
If you were given notice you can, and IMHO should (RAV will demand it), have your sick leave extend the notice period.
This is how it works:
- your contract ends at the month's end
- the first day sick extends the notice priod into the next month thus the new end date is the end of the next month
- additional sick days are used to fill up the remainder of the month, so up to 31 days extend your job contract by one full month
- Dec has 31 days, so the 32nd sick day extends it into January and thus makes Jan 31 the new end date
My employment contact was extended for the three months, but that is ending now, so employment relationship ends. The sick leave will count for those three months, but not after because technically I am unemployed, even though not well to work. I will still receive sickness pay but I believe that the payment after employment relationship ends will not be counted in the 12 months.
