Refusal to renew B Permit after divorce?

Bye bye

It entirely depends on individual circumstances so no one’s going to be able to give you a definite yes, you can stay or no, you’ll have to leave.

Until a divorce is finalised you still have your permit so yes if you can find work you can do it. Whether you’d keep your permit obviously depends on what the Swiss authorities decide regarding the length of your marriage and how integrated you may be.

If they decide against you, then either your employer (if you have one by then) will have to apply for a new permit as you’ll come under the non-EU hiring criteria, or you’ll have to leave the country.

Its mean ?i have to leave anytime soon ?

Just check out the links Medea posted

forum legend its a valuable let me check and get back to you.wat happen if my partener doing alone ?

No, only when the divorce becomes final if your permit continuation is refused by the Swiss authorities and any employer refuses to go through the non-EU permit application process or any such application is refused.

that s mean i can be confident that as long im fianncially independent or working (even odd jobs little)..keep improving my french..atleast i can stay up to another year...without hesitations ...(Mars 2018 )..immigration not authourize to do any force action against me during my stay of another year right.? If they do notify me i can clarify them in such manner right ..there is procidure i guess if they ask any i guess...as I'm having valid permit and i'm my own..thanks for reply Medea Fleecestealer.Your reply made me feel some how good with a little hope

You can stay as long as you’re married or until your permit needs to be renewed. Part of the conditions for getting the permit are that you live with your spouse. If that’s not happening then the permit may not be renewed. Of course, that will depend on where you are regarding separation/divorce proceedings.

one of another friend quite curios to know dat his case (non european) his marriage lasted 2 years 7 months.now his partner only already notified that their are seprating.this guy not agreeing really.i think its seem he going go through lowyar.dat case ..i belive its take 2 years right for official dirvorce..then wat might happen to him ?he will apply for renewel of his permit by next month (as its expring its 3rd year ) for 4th year ..

present he doest have a proper job .His permit get renewed further ? wat's his chances he will be allow to stay her for nother 2 years ? (till deceison come out) ..by the time deceison come out he have leave right ? tq for answers its really helpfull ..sorry for lot of questions

See previous answers and it depends on their individual circumstances.

Hallo Sam,

I have similar situation like you, my marriage with Swiss man here in Switzerland almost 2 years. My husband live in zurich (we are separated) and i work already 1 year in Bern. But we just separated in 1 month, now i live in Bern.

In my process of Anmelden, Kanton Bern rejected my request because my B permit almost finish May 2018 (and now March 2018).

So in this case, the one and only i can do. Ask my employer to help me prolong my permit living with Work Permit.

Do you have any suggestions to me, how the process and what should i ask from my employer for the very beginning of the process.(i know latter gonna be alot).

How about you right now? Coz your post was 2008.

Hows your life right now?

Your employer will have to go through the non-EU hiring criteria which will cost them time and money. They need to prove they can’t find a Swiss/EU national who could do the job.

Ow,,, i don’t know if my work is special (no one could replaced me).

I an Asian, and i make relation between my Company with Asian Embassy and expand the market in Asian and also i make accounting and support some others Projects.

Do you think they want to figh for me, (my employer),, so far i have good relation with my employer.

Only they can answer that. It will depend on whether they think they have a good chance of getting a permit for you.
