A break or a break in?

Need to get a new catch for one of my windows, but couldn’t help but think this is deliberate damage? I see saw marks? What do you think?

No, but it could be deliberate damage by a pissed tenant

dunno, I don’t see any saw marks, but the upper metal part looks to be chipped off, I guess that’s the inside side so… maybe the window frame got deformed and was just blocking on that part so the tenant decided to fix it that way it instead of fixing the worn out hinges
