Hi Everyone
Its been a while, i am normally just lurking within the shadows.
I have a couple of questions.
Firstly a short intro.
Current situation:
I am (non EU) married to a Swiss, we have 1 daughter (3.5yrs) and I have a B Permit. My partner owns a GmbH and can therefore not proceed with the "Abmeldung".
Goal:
Going on a trip for 6-12 months. My partner can work from anywhere. Plan was that we both do the "Abmeldung", collect our 3rd Säule and BVG in order to buy a house in a non EU Country. My wife can not, this option won't be possible for her.
Questions:
Am i only allowed to leave Switzerland for 6 months without having my B permit revoked. ( Note i am due to recieve/apply for my C Permit/Citizenship .
1) Will I be able to take all my retirement funds with me? (to invest in property) I.e Just withdraw my funds and my partners stay intact?
2) After our return, will I have "repercussions" because i have taken out the money?
3) Has anyone experienced any problems in reapplying for a B permit after having had have left the country ( we will still be married and will be till the D do us part)
4) Will the taxes have to be paid upfront, meaning before I leave?
5) How many days can one really stay outside of Switzerland without loosing the B permit?
Any help, input, suggestions is highly appreciated - THANK YOU
Why can your wife not do that?
You can stay out for 6 months.
Impact of withdrawal - no unless you try to buy back missing years and deduct 6 months later at which point the authorities may wonder if your Abmeldung was all a tax optimization scheme.
Depending on amount you have in your BVG you may want to consider moving it to Schwyz.
Yes you can take all your money independent to your wife's choice.
Hi
Thank you for your input
After some research:
1.Would have been better to withdraw her funds as well, there are high tax implications for doing that?
-we only need one of them.
-abmeldung would mean she loses directorship of her business?
-the Gmbh is registered in Switzerland and the owner needs to in Switzerland?
In my case:
-the non EU partner would have to reapply for his/her B Permit on re-entry, if the stay exeeds more than 6 months.
-after must research ,one could ask for a 6 month break from the Kanton, without losing your B permit?
-i am taking 6 months unpaid leave, the abmeldung process would have concequences on my employment,(lets say i kept quiet about it) ,and re entered with a valid B permit? would it be an issue?,assuming i take longer than 6 months.
Frankly i would rather not risk it, i am due for citizenship end of next year. Would this affect it?
2.Sending the funds to Kanton Schwyz was an option:
-challenges faced in the future ,would be for the non EU partner having to apply in the Gemeinde if he/she could stay there, and if Kanton Aargau would allow his/hers departure?
Buying back years later might be an option ,but deducting at the same time we wouldnt and never do.
when you say no unless..do you mean i can do the Abmeldung? take my funds out ? leave 6 months? and there would no problem.
