AppleCare and Swiss Law

I'd like to know your experiences with Apple products regarding warranty (Gewährleistung) and guarantee (Garantie).

From my past experiences I can only tell it lives up to its name. IMO is good — but in comparison to others is excellent.

However, I read and heard different stories abroad.

What were your experiences in CH?

Do you think AppleCare is necessary?

Everytime I have bought the extended applecare it has come up trumps. 3 failed iPod Nanos (all replaced with no cost) and one of the early time-capsules (In the "dead" serial number range) also replaced without cost.

Current iPhone is another matter - but that is still on going so I can't comment.

Technically Apple provides the 1 year guarantee, once that year is over Apple have no further responsibility. The responsibility for the 2nd year guarantee then passes to the dealer/shop you bought the computer from. So in the second year you would have to bring your device back to the place where you bought it from, rather than use an authorised service center

This is a pretty crap situation for the independant dealer as it would only take one major repair to wipe out the profit of selling 10 - 15 macs. Basically independant Apple dealers already sell Apple products pretty much as a loss leader. This is likely to make the dealers reluctant to handle issues in the second year, regardless of law.

That said I believe that Apple realise this and unofficially will undertake the repairs in the second year, however this has obviously not yet been put to the test.

With Applecare it's registered centrally with apple based on the serial number of the device, and service is available at any authorised service center worldwide (the exception being the iPhone which must be serviced in the country it was purchased). You don't even need a reciept.

For me it comes down to the value of the device. On a device which costs less than a thousand I probably wouldn't bother with Applecare, but if it was a top specced iMac or laptop then I probably would.

i think apple have been in trouble in other countries for essentially selling warranties which they were obliged to provide for free as part of the law. i wonder if the same applies in switzerland, where there is a statutory level of warranty required.

That's right. That's why in my first post I spot the difference between guarantee which is a separate contract like AppleCare and warranty which is derived from Consumer Law. Both overlap only partially, check this http://www.apple.com/chde/legal/statutory-warranty/ (German only).

Is the warranty from Swiss Consumer Law sufficient or satisfactory to make AppleCare unnecessary — that is in your experience ?

Basically as far as my understanding goes with this law is that the defect has to have already existed at the point of sale. If the defect develops later then it is not covered with this law.

Applecare will cover you in the event that a defect develops after the point of sale, and also Applecare covers you for 3 years as opposed to two.

IMO there's to much room in this law, enabling the dealers to squirm their way out of responsibility. It really doesn't give the consumer much at all. However nobody so far has had any experience of exactly what protection this law offers as it only applies to goods purchased on or after the 1st of January 2013 - the first tests of this law will come early next year.

Anyways, I guess as for Apple being accomodating (kulant) the Law says nothing

My ipod screen got smashed on the second day of use! went back to the apple shop they just replace it with new one, without asking how it happened I still wonder why they did so.

I have heard similar stories from friend in the UK and Germany too.

Did this happen to you in CH? If so, where?

In Zurich. I bought it from Migros but take it back to Apple store.

I purchased and iphone 5 last October directly from Apple. It died in February, Apple replaced it after verifying the fault. This iPhone died last month, again Apple replaced it after verification. With each replacement the years warranty would appear not to start again so I will purchase the AppleCare as it seems that so far my iPhone 5's have a working life of about 3-4 months.

Thanks, I checked it and it gives me until October 23, 2013 for the replacement product I received on 1st July.

The warranty refurb replacement will have the same warranty as your original device unless it's less than 3 months, in which case it will have 3 months warranty.

I've just learnt something interesting today. I can't add Applecare+ to my 3 month old iPad Air since it has to be done in the first 30 days.

Applecare + is the value added package where it includes two rounds of accidental damage. This is different to most other Applecare packages (e.g. Macbook, iMac) where they can be added any time within the first year.
