Dear all,
My husband and I applied for the early C permit "Vorzeitige Erteilung der Niederlassungsbewilligung ". We submitted all the required documents.
My husband has been in Switzerland for 9 years now. He originally came to Switzerland as a student for a masters study. But, unfortunately he was not able to get the certificate because he failed a compulsory bachelor course which was in German. Presently, he has had a regular B permit for 2 years now which is tied to mine on family unification. And he is working full time. I am working part time and also doing the "pflegehelferin" course with the red cross.
We just received a letter from the immigration requesting for our certificates which we got in Switzerland inorder for them to continue to process our application. Even though we have given them proof of our involvement in economic life.
Right now, we do not know the way forward.
Can they legally refuse to give us the C permit even though it is not written in the conditions for the granting of the early C permit? If they do, what will be our way forward.
Please, any advice will be greatly appreciated. As we are trying to gather information before we make any further contact with the immigration.

What certificate? The german language certificate? Yes i'm afraid it's a hard requirement especially for early C (which raises the bar for required level vs ordinary C). But you can do it at any telc / goethe test site on pretty short notice, the only prerequisite is that you pay their test fee. Whether and what you studied in uni is utterly irrelevant for it...
Yes, early C permit is not legally guaranteed, they can refuse for any reason, any deviation from their internal guidelines, so I suggest you play nicely along. But after 10 years you would have a right to ordinary C anyway, with more relaxed rules
No, they are not asking for language certificates. We already provided them with our B1 language certificates. They are asking for diplomas for studies which we carried out in Switzerland.
I am just wondering because in the list of requirements, they requested for proof of work or proof that you are studing. And we already provided them with proof of work. And now they're askimg for diplomas.
Maybe not graduating from a Swiss uni means the student years don’t count?
Hello Madea, maybe they don't count. I'm not so sure. But i don't think its stated in the law that student years count only after completion of studies? What i read was that, student years count only after you spend 2 years on a regular B permit?
What is usually is as far as I know is completing your studies and then being on a B permit for 2 years after that. If there was a gap between him studying and getting a job here or he was on an L permit at any time then that might be the reason.
Send them the last transcript of records he obtained from the university. I guess they want to see how long he has been studying, when he finished his education and determine what he did afterwards.
