Applying for residence with small conviction as EU-Citizen

Hello,

I am german and lived in switzerland for half a year around 7 years ago. After I moved back to germany I commited a mistake (traffic offense, DUI) for which I was convicted. I was given the minimal penalty they can give, which is far below the treshhold of 90 that would lead to it being on my criminal record. Furthermore, this is now over five years ago, meaning that it has also been expunged from the federal register in Bonn.

The canton I would move to asks especifically for “past convictions” with yes/no for answer. Yes requires the submission of a criminal record. I have ordered one and a few friends who are lawyers told that it should be clear, as only penalties over “90 tagessätze” get on it. I am wondering whether this could pose any trouble getting a living and work permit. For me it also seems a bit odd to answer “yes” and then submit a clear record.

IMO I’d stick to the rules of your country: if it says your record is clean than it’s clean.

Minor driving offences are not criminal convictions. Write no.

Write “no” they cant cross check over borders, but if you really need conformation go to the local Gemeinde and ask for a Führungszeugniss.

A DUI on an e-scooter won’t get you a criminal record, just a fine.

Sign no and move on

Just write No. I had much more serious than that in the UK before I moved here, but a spent conviction is spent, ergo it will no longer appear on a criminal record extract, ergo you do not have a criminal record.

It wasnt minor. It would also be a criminal conviction in switzerland. My problem is that

No

I guess you’d need to do that only for a few specific types of jobs, for which you’re not eligible anyway as non-Swiss

Not really, lots of jobs require a clean criminal record extract and debt record and are not just available to Swiss nationals.

Most banking jobs will ask you for a clean record, as anything with children… and most large consultancies will ask for this too…

but again, a DUI on an eScooter isn’t a criminal offence I believe (if your post on reddit is from you)
