I am german and lived in switzerland for half a year around 7 years ago. After I moved back to germany I commited a mistake (traffic offense, DUI) for which I was convicted. I was given the minimal penalty they can give, which is far below the treshhold of 90 that would lead to it being on my criminal record. Furthermore, this is now over five years ago, meaning that it has also been expunged from the federal register in Bonn.
The canton I would move to asks especifically for “past convictions” with yes/no for answer. Yes requires the submission of a criminal record. I have ordered one and a few friends who are lawyers told that it should be clear, as only penalties over “90 tagessätze” get on it. I am wondering whether this could pose any trouble getting a living and work permit. For me it also seems a bit odd to answer “yes” and then submit a clear record.
Just write No. I had much more serious than that in the UK before I moved here, but a spent conviction is spent, ergo it will no longer appear on a criminal record extract, ergo you do not have a criminal record.
