Article 27 Naturalization Act

Hi All,

Article 27 Naturalization Act says

The foreign spouse of a Swiss national who has lived in Switzerland for at least five years, has lived here for one year, and has lived in conjugal community with the Swiss spouse for three years.

Does these 5 years needs to be continuous ?

In other terms if one has left Switzerland for few years then came back do they need to count from zero ?

Ask your local migration office. They can implement an article a bit differently.

This is true in the case of regular naturalization. However for facilitated naturalization it is the federal law that applies. Canton's can't add their own requirements and they don't interpret the number of years.

On the surface, it seems like the 5 years don't have to be continuous, but contact the federal office of migration to be sure. The "married for 3 years and living in a conjugal relationship" does need to be continuous.

The 5 years do not have to be continuous. But you have to be there 1 year before you can apply.

Important the 3 / 6 years must be with the same person, continuous, and the person must be Swiss at date of wedding (for exception see Abs. 3)

Please can anyone help with the questions my 3 Swiss Relations will be asked in support of my application for reinstatment of my Swiss citizenship? (Article 27…)
The application requires me to add he names and addresses of 3 Swiss nationals living in Switzerland. Ive added 3 relatives who are happy to help but would like to know what they will be required to do? What questions they might be asked? P.S. i live and work in the UK.

My references were never contacted. I think they only contact them if they think you may be “dodgy” :rofl:

Mine was facilitated via marriage. But I normally hear that references aren’t contacted.

That’s not logic. If one asks for Swiss citicenship being married, the reason is pretty obvious.
If it’s due to ancestors/family they would want to check if there is a relationship at all to this country. Makes sense to me.

@Beth I can’t clearly answer that but I should think they want to know if they have family-ties with you/regular contact/you visiting (regularly/often), stuff like that.
