We are considering to split up with my husband after 2.5 years of marriage. He is Swiss and I`m non European. We don't have any problem besides his drug addiction. I knew it before but He said that He was at the ending of his drug addiction therapies. I tried everything that I could for him but I cant to it anymore. I just don't feel safe in this marriage.
I've read that after 3 years of marriage, chances are high for me to stay here after some circumstances. I speak Swiss German fluently and I work for Post Office for 2 years.
Is there any chance for me to keep my B permit and stay here?
Hello and welcome to the forum. I’m sorry to hear your news.
You do well to check your situation before making a move. Here are some threads of several others in a similar permit situation (each with a slightly different story, and a range of perspectives and advice): https://www.englishforum.ch/permits-…-permit-b.html
" Third-country citizens
You can have your permission to stay extended if
you have been married for at least three years and have lived in the same household with your spouse (Swiss or foreign national),
you are well integrated in Switzerland (impeccable reputation, good oral language skills, willingness to work or pursue education or training), or
you need to stay in Switzerland for important personal reasons (e.g. social reintegration in the country of origin is seriously compromised, domestic violence)."
i have question i non EU married to swiss for 6 years and living togather in swistzerland for 5 years working in migros for 4 year and 7 months i was on B permit family and now applied for C permit but after that we are getting divorce what will happen to my C permit ? i never took social fund always pay my tax on time no criminal record speak german and working what can happen to me? can i stay in swiss or not ?
If you’re getting the C permit via family reunification I think one of the questions is do you intend to stay married (could be wrong about that, it might be to do with Swiss citizenship application).
i didn’t understand what you mean ? it come all suddenly i want to keep marriage she won’t my c auswiess is under process because of our marriage however i been in swiss for almost 5 years and married 6 years do you think i will have to go back or i can stay ? what if i get C ausswiess and than after 3/4 month divorce happen ? that mean i will have to leave swiss or i can stay ? i am working for almost 4 years 7 month i am working 100%
If you and your spouse signed to say you have no intention of splitting up on your C permit application, then once you get it you do split, I guess they could very well revoke it.
but i meet the requirement getting my own my own C auswies as well i lived in switzerland more than 5 years i work and married to a swiss more than 5 years
Most of benefits like being able to work comes from your marriage. If authorities are going to consider this marriage as a fake, which only existed for the purpose of getting an C after 5 years and being able to work in Switzerland, permit might be revoked on those grounds.
understandable but marriage is truly not fake i am still trying to hold our marriage we will just be separate without divorce for 3/4 months and we will see if things get better and we want to be togather again but if it won’t work than can be after 4 month it will end.
i fulfil the requirements to stay in switzerland for example 3 year marriage living together same house( we are togather same house 5 year) no criminal record always pay tax working 100% speak german level A2 etc this mean i will have my own c than or b ? if b how long i can get my own c i already live here for 5 year 5 times b renew my c file is with migration but meanwhile me and my wife is not getting along and we said we stay in different place and see how it go until 4 months if go well we will be togather if not than no togather but can i stay in swiss or not ?
You don’t fulfill the requirements for an independent permit, because as non-EU your employer would have to prove they could find no one else to do your job.
No one can tell you if you will be allowed to stay or not.

the non eu job things is when you want to apply fresh from other country i think
