B Permit holder - family re-union question

Dear all, I've recently granted B permit from F permit (temporary admission).

I prefer to have few suggestions regarding family reunion process for a B permit holder like me.

My husband is living here since 2012 February with N permit (asylum seeker) - we registered our marriage in 2012 December at Zivilstandsamt Kanton Aargau.

My question is is it possible for me to go through with family reunion system? In other words, can I apply for it ?? - Please share your suggestions/ experience on this issue asap.

From what I know, family reunion is to bring your husband from abroad to live in Switzerland with you.

It doesn't apply for cases where the husband is already in Switzerland. You are already "reunited".

Also, to bring the husband from abroad you must be earning sufficient money per month to support him. This is because (under family reunion) he will be entitled to stay here without working (working is optional) and without receiving public money.

What you are looking for is different, it's if your husband can change his permit from N to B now that he is married to you. I imagine it is difficult if you dont have a permanent work contract.

But what is the advantage, since he is already living in Switzerland?

Work contract in the sense, I work 100% since last 31/2 year and form the day when we registered our marriage here - I am the one who looking after his personal expenses such as Insurance.. etc (no social helps).

If you are married, you have a B permit and enough money to support both of you, then he can change to a B permit. Just go to your Gemeinde and apply!

I'm pretty sure this is correct, but don't be surprised if you have to jump through a lot of hoops and provide plenty of documentation to prove this is not a sham marriage. I'm not saying it is. It's just that you were on an F originally (and probably on an N before that) and then finally got a B, so it's not like you're a simple case. For sure your Gemeinde will know the steps you need to take. Good luck!

Of course our marriage was not FAKE ! We were in love for more than 5yrs - now married - I can understand you point of view but it won't workout in my case..

I didn't imply that your marriage is fake. As Island Money says, since you are now married, you have a B permit and you have income to support both of you it seems like a permit for him should be no problem. I just wanted to give you a heads-up that because you both were/are asylum seekers you may (and that's just may , not an absolute guarantee) have a more complex situation, and one which the Gemeinde should be able to help you get sorted.

I agree with 3Wishes. If you apply for the change in permit expect to be asked some very personal questions about your relationship as they will want to make sure you didn’t marry just so he could get a permit. They’ll want documented proof of a long-term relationship so gather anything that might help you show them that it’s genuine. As part of that they’ll want financial records showing that you earn enough to support you both as initially I would think his permit will not allow him to work. That doesn’t mean he can’t look for a job because he can. When he finds an employer he’ll need to take his employment contract to the authorities so his permit can be changed to a working one.

Yes. He will be your dependent and as such I don’t think his permit will allow him to work at first. But he should be able to look for a job. When he finds employment he needs to take his employment contract to the gemeinde/commune and they will start the process to change his permit to one that allows work.

Obviously you need to check all this with your local authorities, but that’s the way it usually works when a non-EU who’s married to another non-EU has a dependent’s permit. Because they are financially supported by their partner the permit only allows them to live in Switzerland. But if they can find a job, then permit can be changed so it allows them to work as well. I’m assuming it won’t be different for those who were/are asylum seekers. That’s why they will want to make sure your salary alone can support both of you, because initially he won’t be earning any money.

All spousal B-permits are given with a right to work these days.

Can anybody tell me how much it should be a person earn (per month) to prove my earning is quite/well enough to cover both of our expenses ?
