I have read many threads and am confused as to the exact right of a B Permit holder to work in Switzerland.
I realise they have the right to live and work here and can change jobs. BUT if a B permit holder is offered a job with a contract etc, I understand you still need to notify/apply with the authorities for a visa relating to the new job?
Or is my understanding incorrect and you can just accept the contract as long as you register/pay relevant taxes and insurances.
If you do have to register for a visa for a particular job, can that be turned down on the basis of salary?
Again, I have searched for the answer. If there is a specific link I have overlooked, please point me in the right direction.
Assuming you are referring to non-EU B permits then you do not do anything - your prospective employer has to do the administration (worst case you may be asked to go the local town hall and present a copy of the contract).
Salary is an important factor in the authorities decisions - it should be at the same level as for anyone else.
Thank you - and yes, I read the sticky thread. I am wondering about applying for a nanny visa for an EU-17. It says they have the right to a visa upon delivery of a work contract.
I've been through the process of applying for a nanny visa for an EU-8 and got turned down (had to prove no Swiss could to the job and pay a minimum salary, which was beyond my budget and beyond anything the nanny was offered elsewhere - she has since returned to her home country as she feels it will be impossible for her to be offered a job at that level).
Now found someone from EU-8 who accepted a fair salary (but still lower than that stated on the previous nanny's refusal letter).
I have not been able to find any information about minimum salaries and not sure if it is an arbitrary decision and if it is only applicable to discourage EU-8's. I was told (without being presented with any evidence) that Swiss or EU-17's would not be subject to the same salary requirement.
I do not want to waste another few weeks going through the process to get another refusal letter and then have to start all over again. I have to make arrangements that hinge on this process.
So if it says that someone is entitled to work upon presentation of a work contract, can that still be turned down if the salary is below a certain number and how can I find out what that number is?
Like a lot of things, it may vary a lot by canton. In Geneva, there are certain edicts for employment, some giving minimum salaries for certain jobs. See the attached link, go to the recent modifications in Jan. 2010, and you can see minimum salaires for domestic workers. Also, don't forget all the insurances, etc. AVS, health, accident, pension, etc.; and limits on working hours, etc.
