Hi! I am a non-EU holder of a B permit since 2017. My eldest child will be turning 18 next year and then she will leave to take up university - likely outside Switzerland. Do you know if she can still retain her B permit while studying outside? She will come back and stay during holidays with us.

Why are you not applying for the C permit, you have already finished 5 years?

Then your child can keep the C permit up to 4 years without any issues.

You are wrong ( Link ) But judging from your misinformation in the field, I am assuming you don’t speak French (otherwise you would have read the canton’s website which clearly states that you can)…

Après un séjour continu et ininterrompu de cinq ans au bénéfice d’une autorisation de séjour durable, il est possible de déposer une demande d’autorisation d’établissement à titre anticipé. L’examen de la demande tiendra compte du degré d’intégration des membres de la famille âgés de plus de douze ans.

Une certaine maîtrise de la langue française est notamment demandée: vous devrez en effet attester d’un niveau B1 (PDF, 276 Ko) du Cadre européen commun de référence pour les langues (CECR) à l’oral (au minimum) et A1 à l’écrit (au minimum) dans la langue nationale parlée au lieu de domicile.

All can apply after 5 years if they meet the good integration criteria. Many EU persons, likes those from Poland, Hungary, or Croatia have to follow the very same path.

Thank you for the suggestion and apologies if my note was wrong/confusing in any way. I will look into it but in the meantime, do you know if studying abroad is a ground for revocation of a B permit even if her permanent residence is here during the holidays/school break?

Keep her signed in, keep paying health insurance, she comes back in the hols, you shouldn’t have a problem.

So long as they’re not out of the country for more than 6 months at a time should be okay. Do that and the permit becomes invalid.
