Betreibung [Debt Notice]

I searched forum but too bad for me I found more than one answers...

So today I received a Betreibung for a Migros Kurse which I said that I will attend and finally I didn't.

I decided to pay it tomorrow(one day later)

After tomorrow's payment...

The whole thing will affect me? I won't be able to ever rent a house? After I pay tomorrow can Migros delete this record?

Please answer if you 're 100% sure.

When you say "Betreibung" do you mean "Mahnung"? Did the debt go beyond the reminder stage?

Or in other terms, how long after the deadline did you wait?

After two mahnungs today came the Zahlungsbefehl from Stadtammannamt und Betreibungsamt (Betreibung Nr. xxxxx)

Basically you are screwed.

Pay tomorrow and go to the Migros Schule office to tell them you have paid, explain why you didn't pay earlier (illness, whatever..... btw why on earth did you wait so long to pay after 2 reminders) and ask them to withdraw the Betreibung as you have paid, and ask them to send you written confirmation. There might well be an extra admin cost added to your bill, I'm afraid. You don't want a Betreibung going against your name officially- as it does cause lots and lots of problems.

If you booked the course, and did not attend, you cannot dispute the Betreibung. What were the circumstances?

Pay & then dispute the Betreibung, you ask to go to court, Migros will drop the case

When they asked I said I ll do the next Kurse and signed a simple paper but after I found a job I couldn't.I Informed them 6 days before the Kurse start but they said I should informed them 10 days earlier...

After that they send two mahnungs and today this Betreibung from Betreibungsamt.

In the end I just wanna pay and don't have future problems...

If you don't pay one of the Mahnungen, and receive the Betreibung you will also have all the extra relevant costs to pay. That is standard Swiss practice. Don't pay the Migros, now you must pay the Betreibungsamt, pay all the costs indicated!

You have decided to pay, and you will still be paying too late! You will have to persuade Migros to go the extra mile, and ask for your name to be removed from the register of debtors.

If you don't get it removed, your name will show up as once being in debt. This is quite serious, as you now know! In a contest to get an apartment you will never come first.

Swisscom charge an extra SFr 50 for the extra letter to the Betreibungsamt, I don't know what Migros charge.

There are companies which will not remove the info even once the debt is satisfied. They maintain it is to warn others against you.

Many people such as yourself had plenty of time to try and resolve the matter before it reached the Betreibung stage. What were you expecting to happen after you ignored 2 reminders?

Which is why paying & disputing the claim is a better bet as they will not take the matter further as they have no case.....

What's to dispute? The Betreibung is 100% correct in this case.

talked with Migros and they told me that they will send a letter to Betreibsamt(one copy to me as well) asking to delete my name from the list.

After this is there any chance I have problem with:

1)rent a home

2)lease a car or bank loan etc?

If your entry in the register is completely clear then you will not have problems.

In law you can dispute anything, by the time it gets to court there is no debt. It won't go past the point of being disputed....... so it looks like there was no case to answer

once the betreibungsamt has cleared the debt (which can take a few weeks) there will be no evidence (as far as I know). Don't worry

But that doesn't mean that the Betreibung is no longer in the system either, it would just be in there with the comment that it was opposed.

In this case the OP has said that Migros have agreed to have it removed (good on them), but they would have been under no obligation to do so. Once a Betreibung is in the system it is in the system, whether you pay the outstanding amount directly or through the system. It doesn't just evaporate....

There will be an entry in the register showing the debt and when it was paid. It will remain (and be printed when you request the form to apply for an apartment, etc.) for, I think, two years (though it may be more).

If it's opposed & they don't go further, they are accepting that there was no grounds to issue the Betreibung, or they would take the matter to court.

Remember anyone in CH can issue a Betreibung, they don't need a valid reason, I have been threatened via a lawyer in the past, It was very funny to see 5 years later that the lawyer had issued a Betreibung against his client who did not pay his bill or any other bill going back 10 years
