Bought a vacuum from Interdiscount - seems it's not new?

I bought a Roomba yesterday from Interdiscount - it's a robot vacuum cleaner. While unpacking it and setting it up I noticed that the battery pull tab was already removed, and it shows signs of use (lots of fluff already in the wipers.

I haven't yet used it - am I within my rights to take it back and ask for a refund? Or is this normal?

If it has already been used (maybe it was an ex-demo mode, or a cusotmer return) then I would take it back and speak to them before using it, because if they are used or returned items then it should be clearly marked as such.

Swiss law is very clear on the point that unless an item is expressly sold as used/demo/etc, then it is to be new and unused. (This doesn't mean that someone couldn't have taken it from the box and looked at it, but not used it.) You are entitled to a refund or discount at your discretion; you do NOT have to accept the used item if you don't want it.

I would take it back and explain the issue to them. They have to give you another one and make sure nobody has used it before returning it to the shop.
