So recently I received a call from some insurance company claiming to give me advice on insurance. I am a student and I don’t know much about the broker situation here so I met this person.
She explained the plans and I was interested to know more. She asked for my personal details and made me sign some documents from the company. She claimed this is ONLY for inquiring if the company will accept my profile and this is not a contract. I have asked more times since I don’t want a contract yet and I will only take it if I get SVA and she emphasized that was not a contract but just inquiry.
However a few days later I received some contract from the insurance company!
Now she told me it is hard to get rid of it.
I know it’s stupid to sign such things but she was clearly lying to me to make me sign! This is violation of article 45??
Is there anyone who has experience on this? Is it possible to get help??
It would help to know what exactly you signed and what else do you have in writting from the agent. Especially "not a contract but just inquiry" - do you have this bit in writing/email? If yes, use Art 23 & 24 OR to void the contract. If you have nothing in writing it gets tricky, as the burden of proof is on you.
Edit: another law that can help is https://www.admin.ch/opc/de/classifi.../index.html#a3 - did the agent inform you about the items listed there, especially premium/year? Here I think the burden of proof that they provided the info is on them, so it'll be much easier to ditch the contract this way
It looks like the contract you signed is for (mandatory) health insurance, which would make it something different than what SVA ("SozialVersicherungsAnstalt"). Every resident (a few rare exceptions apply) must have health insurance, if you're not newly arrived (your EF membership indicates that you aren't) you should already have mandatory health insurance.
It's important that you mention this fact when you contact Mutuel Group when you contact them to cancel your new contract.

I would say that it’s for supplementary insurance as they have to cover everyone for the mandatory insurance so there would be no need to check if they would cover him.

I only plan to change when I meet the 6 year Limit with Swisscare.
I did not sign a contract yet but according to the document the broke sent. She ticked that “it was a official request for contract”, but what she said was “just to check if the company will accept my profile, not for a contract”.
