So here's my situation: I am EU national starting a job in Zurich in February 2023. The company told me to present a permit before my first day. I will come to Switzerland and register in December and I'm currently negotiating a short, one month contract with another company for January.
My question is, if I apply for a permit B with my February, unlimited contract, can i also take the January job legally?
I know I can work up to 3 months without a permit but it would be in case I actually work only up to 3 months in calendar year which is not really true as after January I would be employed for the rest of the year.
I would not jeopardize your permit application by doing this. I am pretty sure it is not allowed, but even if you found a loop hole, you run the risk of impacting your application process.
take the January contract in your existing EU country.
You make it sound like I want to do something shady I'm not looking for a loophole, just a legal solution, it's not a standard case but it also does not sound like something that has never been done before.
I can't take the January contract in my current country as it's a Swiss based job.
@roegner That's what I also assumed, now I'm trying to figure out if it can be done at all, maybe I should apply for a different permit, in any case, I wouldn't do anything questionable.
You're an EU citizen so you have right to work here, whether for a one month contract or and indefinite one.
I suggest you come here for January, register at your community. Show them both your contracts then they'll start the process. I really don't think there will be any issue - you'll get a B-permit.
Bad wording on my part. I am just saying, you run the risk of impacting your application for a visa for the permanent role in February. Don't work in CH until your permanent B (or whichever one) is in place. That said, others are advising that it is ok so Im possibly being too risk adverse.
Ask your local gemeinde where you will be in January. You can already ask them now, (for example mine will answer via email etc.).
Yes, that would make sense, I can't imagine why would it be a problem, a guy from EU comes to Switzerland, works for a month in one company and then works for the rest of the year in another, sounds simple. But I also don't want to accept the January contract if it would turn out that I can't actually work for them when I go to 'Kreisbuero'.
Yes, it may be the best idea. Even more natural thing to do would be to clarify this with 'January company' HR but I once almost lost 30k in tax exempt because HR insisted I don't qualify while I actually did so I like to know the law
