The driver will get fined if he was speeding & on the phone, the Police always investigate accidents. What was the speed limit, 30, 50, 60 ? You do realise that at 60 the chance of survival is very low, only breaking a leg does not sound like excessive speeding to me.

That has zero effect on you or your daughter though. Him being on the phone does not increase your daughter's suffering nor will it entitle you to more money

As the driver was speeding, then be very very grateful your daughter is alive. For collisions at 50kph, pedestrians have a 50% chance of being killed.

As already stated, but you seem to have missed it: the driver will be heavily fined and may face jail. Frankly, I'd throw away the key.

the driver is going to be severely punished, we're talking massive fines, long ban and depending on his previous driving history and how the judge is feeling that day, prison.

Other than that, stop panicking. Private liability insurance, even if the driver was insured in Austria will typically cover damage of up to 10 Million Euros. We all know Switzerland is expensive, but not that expensive.

Keep all your costs documented and you will be reimbursed.

Do you feel your daughter hasn't been treated medically/psychologically correctly or fully?

Do you feel that the driver is not going to be punished?

I get lawyer to assist my part,my daughter health insurance paid everything.Some of you put an assistment that i want more money,may i ask you is it wrong to ask and to say what i feel?that that time i dont even have a chance to work because i need to assist my daughter need,that you are working per day basis no work no pay,..and in the end of the show insurance will pay this amount to us,not even give us consideration to rebuild my daugther leg again for atleast she will have a normal life?..i am

Asking an opinion but pls dont judge..yes i am expecting a normal amount for her not small pr not big,to compensate our expenses the salary that i lost that time..if this is the law here in switzerland then its fine..i can accept and i have nothing to do with that..
