Car accident pain and suffering compensation

You mix up many thing and have a wrong conception how things work:

1) The drivers-cars liability insurances will not pay out any punitive damages. Only actual cost incurred.

2) If there was any wrong doing from driver he will get punished according to the law.

3) In a criminal case (traffic law can be criminal law in Switzerland) the court will not assign any punitive damages to be paid to the victim.

4) Your daughter can be a plaintiff in the criminal case and launch civil action in the criminal case against the driver.

5) She can request damages but they will not be very high and may not be as much as requested.

6) In certain circumstances she can get additional damages paid by the state.

7) Most importantly if you do not ask for it, you will never get any thing. Nobody hands out money just because.

all your medical bills will be covered, so you and your daughter don't need to rebuild anything??

everything your daughter NEEDS will be covered, and no more

its a broken leg FFS not brain damage

Pleased we have sorted out that the accident insurance picks up all the costs.

The accident insurance will pay for extra care if you need it. All legitimate costs will be covered, and not a cent more.

WADR...

I am having a bit of trouble reconciling the highlighted parts of your post. Please elaborate.

If you would read what was answered, you would see that this has been answered now umpteen times?

Speedy recovery for your daughter!

Yes. But you must claim it. If you can show that you were off work to look after your daughter (being a single mum), and suffered loss of earnings, then claim from the drivers insurance. Document all your expenses and put in a claim.

If your daughter needs physiotherapy or psychiatric care, this will also be covered.

The driver will be punished in accordance with Swiss law.

Anything else you need to know?

The accident insurance will pay, no need to launch a claim against an Austrian insurance company in Austria.

Thats my point,you've got it...

....

Ues exactly thats what i want to ask if i can claim n that part..

This really is like pulling teeth.

Let's try again:

You can claim costs and expenses, including lost wages, but you have to claim them and provide receipts and other evidence.

Tom

...

I pay 10 percent of the hospital bill

As we all do. Wouldn ́t this be covered by the accident insurance and not your health insurance? Just wondering.

When I had an accident, I did not have to pay anything as all bills directly went to the accident insurance and not my regular health insurance

So your daughter is fixed and paid .. Good..

You are entitled to claim back any expenses and lost salary.. You can claim back anything financially lost as a direct result of the incident. We've all been saying that !

So claim it .. Is that the 2700 you received? You got it already?

So what else do you want opinion on ..

A guy I know lost two fingers in an accident at work. Company (large Swiss multinational) entirely at fault. Even he didn't see a penny.

Yes i saw many good advices here though some is hurting me but thats okay..thank you so much

Not exactly fixed, she still needs another operation etc..

We didnt recieved yet the money, and in already spoke witj the ombudsman and they will review the case of my daughter..its really something wrong thats why..

Anyway i am ready and will accept whatever the decision but atleast i tried my best for my daughter..

Many thanks

Including the 10% of hospital fees.

..

That is also another big question but may e because the driver insurance is Austrian insurance company..and we paid 10 percent of it..so the 2700 is also included the percent taht we pay in the insurance..

True, but you were probably employed at the time, no?

Tom

you should require the insurer to pay the actual costs, not some kind of a lump sum.

The driver's insurance has nothing to do with anything, why do you keep bringing it up?
