Hi everyone,
I remember reading a discussion about this topic on this forum, but I couldn't find it through a quick search. I am from an Eastern EU country and the standard requirements apply to me for obtaining a C permit. I have two options: apply for an early permit C after 5 years and hope it gets approved, or wait 10 years before applying for it on more solid grounds.
As I am approaching the 5-year mark, I am wondering if it is strategically better to wait and apply for it in the canton where I have been residing for the past (speaking of it in the future) 5 years or if it doesn't really matter and I can move to another canton and try my luck there. The language is another concern too but let's put it out of the picture. Has anyone had any experience with this or know of any stories?
Thank you.
In principle, C permit is only based on residence in Switzerland, not in a specific canton. As long as you have lived here 5 years with the right kind of permits and fit all requirements, the cantons you've lived in shouldn't matter, beyond being able to prove that you are well integrated and speak the locally-used national language at the appropriate level.
In practice I know people who've been told by migration officers that their C permit "clock" had been reset by their change of canton. That is incorrect according to the federal law, but I guess not all clerks who work at the cantonal migration offices or at the commune always know what they're talking about.
Thanks the last paragraph is actually the aspect I was interested in. Since for my EU country it's at the will of a clerk, I guess it's safer to be patient about the move then. I guess if I moved to a German-speaking canton, and applied after having lived there a year or two, this kind of integration would have looked much weaker than a history of a continuous stay in a French-speaking canton in the same place. Putting outside the aspect of the language itself.
You can move to whatever Canton you want before your C permit application. The only thing that will change is your language requirement if you move from a French speaking to a German speaking Canton. C permit regulations are federal affairs and not of the Canton or Gemeinde/commune.
Your commune has no control over granting or preventing you from applying for a C permit, that right is in the FNIA/AIG. Regarding the c permit they are paper pushers, nothing else. All decisions are made at the SEM not the commune.
For naturalisation it's of course different and the commune does have control.
Hello.
I am a French with a permit B living in the Canton of Nidwalden. On their webiste it is explained that i don't need a language certificate to move from B to C. But I have read more and more comments stating that a law changed. I will ask the Canton soon of course, but i was wondering if someone knows it.
Thank you very much.
It's very recent, so the cantonal websites might not reflect the most recent information yet, but the federal Directives do. It's not a new law but a new interpretation of the law following a decision of the federal court. The exemption from language requirements that used to be granted to nationals of countries with a bilateral agreement with Switzerland is no longer applied. In principle, the requirement now apply to everyone.
Per the link from bowlie above:
So in Vaud you would not need a language certificate. But in NW, I guess you will need a German language one. Unless the 1 May deadline applies also and you can squeak in before then.
Hello guys, sorry for disturbing this topic in new in the forum I was posting a thread yesterday but it didn’t showing up i don’t know why maybe I’m new but I want to ask questions if possible to recieve a answer from you guys 🙂
Basically I’m from Bulgaria I was living in Canada and UK now I have opportunity to start a job in Switzerland for first time . I’m with EU passport but needed permit as well - the Swiss company who offer me a job contract and accommodation is in agriculture, farm working which I have 9 months contract for them and they will take care for the permits for me
My question can be stupid but is there any reason if I’m start working while waiting for this approval/ permit card etc government to refuse the company to give me a permit ?
And second question company told me , my salary will coming in my EU bank account , which I just want to ask if this is true also ?
( I’m asking because I’m from those people who are always hearing story’s about Switzerland and the strong work requirements and everything so please if someone know ..
Best regards
