company car - driving ban

Hi there fellow CH expat community

I have been driving a company car, as the main driver.

I forgot (genuinely neglected) to inform the insurance company about a driving ban for 3 months for speeding after it expired.

The question is: Where do I stand?

PS: Its a company car, anyone can drive it, i didnt think that this was relevant. Now we changed car and the insurance renewal document was asking the question:

'' The following questions relate to the policyholder and the most frequent driver over the last three years:

Has your driver's license been withdrawn for three or more months in the past?''

It came as a shock to me. Stupid, perhaps i know.....

The key question is - were you driving during the ban?

no. during the ban, i was in Japan.

I respected it fully and solemnly. After the ban, I took my licence back by a-post, and i got in my car.

But i didn't notify the insurance chap (how stupid, i know) the fact.

Did you have a contractual obligation to inform them at time of the ban?

If you fail to provide the information required then you run the risk of them refusing to cover any large losses - when the loss adjusters start to look for reasons not to pay out.

I think this is a standard question when you take our an insurance for the car - they asked us also as new car owners and you need to tell the truth. I don't know that you need to inform the insurance during the event?

In my limited experience, the T&C contain language stipulating that you must inform the insurance if any of the data you provided in the questionnaire changes. I would expect that to apply in general.

See Mobiliar's explanations for their T&C below, abridged because I've removed the consequences (which typically go like "otherwise we may cancel or you may have no protection").
