Didn't go to the Appointment with RAV

Hello everyone,

I have been really stressed this week, and I made a confusion about the day where I was, so I didn't went to my RAV appointment, today I received a letter from them, I called my 'personalberaterin' and she told me that I will not receive 5 days and we made a new appointment for tomorrow.

Can she do that?

it's the first time that I don't go, I always do everything right and on time, I think we should have first a kind of warning...before being penalised...like..."next time you will suffer the consequences".

Can they do that? - Yes.. I know two swiss guys who had the 5 days no pay fine due to not showing up.

AT the end it depends on your relationship with the RAV guy/girl in charge. Some play by the book and some are a little bit more flexible and down to earth

Did you at least call them on the same day to inform?

Of course, they can penalize you for not attending the appointment.

When you are late doing your "Arbeitsbemühungen" and the Replys "Absagen" from the companys, the can punish you as well.

It is not fun and games at the RAV.

Got Trouble myself with the payments of the RAV.

Of course she can - it's all in the welcoming information package that you get when you sign up at RAV - surely you have read them (at least when you had to sign that you have received and understood everything of it) and know your obligations just as well as your rights?

as mentioned already, yes they can and they will have the pleasure to tell you how they may do that, which I find fair. Because you have been already told to not to miss your appointment unless a serious acceptable reason.

You need to understand the real purpose of the RAV. It is not to ensure you get paid or help in the process of finding a job, but to ensure you comply with the terms of your qualification for continuing RAV payment and notifying the insurance if you fail to do so.

Hitting jobs targets, turning up for appointments, accepting job offers, no unauthorised absence etc is all good, failure to comply.... and they wield the penally hammer with all the skill of Thor himself.

The RAV don't pay you - that falls to the unemployment insurance office - but they do determine if you get paid. You work for the RAV now. If you failed to do something for your employer you may expect disciplinary action.

A weeks salary is going to hurt most people, especially as in RAV-land there are only 21 days in the month and it must sting. The RAV - much like cops - aren't famous for their sense of humour. Lesson learned!

Hard to hear but keep going.

If you were working, that is a valid excuse not to turn up, I did that on many occasions.

But you have to drop an EMail to your RAV Agent before the appointment, otherwise she can punish you with "Einstellungstage".

The RAV system is the fairest one can get. They take away money from those who fail to show up and give to those who obey the system instead. Can one really ask for more ?

Yes, you can .

When there is mobbing or bossing involved, which made the person to sign

an"Aufhebungsvertrag" , to escape the pain and terror immediate.

The victim will be punished twice, he left his job(have to look for a new job, which is not easy these days) and will be punished from the "Arbeitslosenkasse" with a minimum of 30 "Einstellungstage(up to 60 Einstellungstage)".

This is disgusting and have to be changed.

Another stupid thing is the "Bescheinigung über einen Zwischenverdienst", if you are unemployed and work a day in a month, the "Arbeitslosenkasse" will

not calculate the whole month before they get the formular filled out by your employer.

The payroll for this month is good enough. That's stupid !!

Rules are rules, people don't have to make themselves unemployed, that is voluntary descision. if you chose to leave one job without one to got to, for whatever reason, then it's your choice, and non RAV funded for a period of time.

Or even, in the case cited, no RAV at all if you give up your job voluntarily, whatever the reason. You have to demonstrate that you have discussed any issues with your employer- and given them a chance to improve the situation and work with you to find solutions- and only if none of this works (and it has to be well documented) would you be able to leave and expect RAV to pay you. In the case I cited previously, the guy didn't do this- and even after going to appeal, he lost and got nothing- because he didn't go through the process of talking, mediation and possible solutions.

They are really cracking down on this- as there are far too many people who work the necessary period of time (12 months in last 2 years) then just leave and sign on.

The golden rule when having trouble at work is to immediately visit your doctor and get a sick note. This man did very well,

Also, if you were sick on that day or had an interview, in which case they may ask you for a proof. Other than that, they won't bend.

Discretion would be nice. A missed meeting with a RAV advisor isn't really a matter worthy of fining someone five days salary IMO, but yes, rules are rules. Do it twice... ok. But first offence?

Consider also, in the first month of unemployment the first ten days of claiming - in addition to the 30% reduction in income - are not offered: that's five days plus ten out of a total of 21 where there's no money. Six days salary is probably good for the rent but won't cover much else. Does the penalty fit the crime?

Rules are rules but good Rulers show discretion and don't put people into hardship.

My advice to everyone uncertain about the language or living with the RAV is to find a friend who'll translate / help. Funny though, how in hard times you learn who your friends are.

You do NOT always get penalized. The rules are you MAY be penalized. I wasn't when I quit my job. Many unemployment councilors take things on a case by case basis.

I'd like to comment further but I can't as I don't know what you are talking about. Can you please remember to translate any foreign terms into English. It is proper etiquette as not everyone on here speaks German.

revised form:

When there is mobbing or bossing involved, which made the person to sign

an"Repeal contract" , to escape the pain and terror immediate.

The victim will be punished twice, he left his job(have to look for a new job, which is not easy these days) and will be punished from the "unemployment fund" with a minimum of 30 "Penalty Days(up to 60 Penalty days)".

I was multiple insulted by a chief, my deputys betrayed me, they (and a complete part of the team) did a refusal of work .At a SOP I did, I got a comment from a chief, that i would compromise the operational safety of

the organisation . I did not get any informations , when somebody of my team was invited to the HR to have a conversation. The chief prohibit me from getting in contact to other departments and arrange repairs without

his permission. The list goes on and on.

The best part was the plan of the chiefs, that would made about 90 % of my team redundant (don't know what kind of work they should do, they face also a financial loss, because there will be no supplements for night work or sunday shifts.

The whole organisation is so unreliable, the toss out 146000 Liter Milk

in the drain each year, they toss out around 104 tons of leftovers.

This is disgusting and have to be changed.

Another stupid thing is the "Certificate of a bewixt profit", if you are unemployed and work a day in a month, the "unemployment fund" will

not calculate the whole month before they get the formular filled out by your employer.

The payroll for this month is good enough. That's stupid !!

It's reasonable that you should show how much work you have done, before they give you your unemployment pay, otherwise they will pay too much & you will have to refund the money.

I did this, i included my payslip from that day.

But this does not satisfy the unemployment fund.

Your employer (for that day) have to fill out the certificate of a Interim earnings(2 Pages) and have to add your contract(if there is one).
