Divorce in Switzerland for foreigners

Hello to all members and the Forum

I am from Italy and my wife is Russian. We married in Zurich on 2010, have a baby girl same year (now 6 years old - Italian passport) and my wife has a 13 year old daughter with Russian passport (without father, wife not previously married). My wife started working November 2014 (now gets around 6 thousands per month) and suddenly this Christmas (yes.... VERY suddenly...) remembered to tell me that she doesn want me anymore. Have done everything I could, but Situation still remains the same.. I am working as well (around 8,000 per month). I want to ask if in case of divorce she will be enforced to leave the country possibly with the girls together (I and Little girl have C Permit, she and our old daughter have B Permit).

Thank you for all advices..... A desparate man....

Sorry to hear about your marital situation.

It appears that she (B permit) and the two children (B and C permits) would be able to remain in Switzerland to the extent that they are in Switzerland under family reunification. This is from ch.ch:

"In case of divorce or death: right of foreign spouses and children to stay in SwitzerlandAre you a foreign national and have been granted a residence permit under the family reunification programme? In certain circumstances, divorced or widowed spouses and their children can stay in Switzerland following a divorce or the death of one of the parents.

You have a residence permit (permit B)

Persons from non-EU/EFTA states A divorced spouse’s or child’s existing residence permit may be extended provided:

the marriage lasted at least three years in Switzerland and the spouse / family lived together, the persons concerned were successfully integrated in Switzerland (reputation, knowledge of the language, willingness to work) or important personal circumstances make it necessary to continue living in Switzerland (e.g. persecution in their home country). You have a settlement permit (permit C)

Spouses and children over 12 years old who have come to Switzerland under the family reunification scheme obtain a settlement permit after five years of continuous residence in this country. They also have the right to settle in Switzerland following a divorce or after the spouse’s death."

Thank you.. I guess if she loses her job then.. better not think of that.

Thanking you on the advice, any (rough) idea on what should I provide as month payments for alimony?

Also, in case I want to leave the Country (going UK for example) would that affect them living here?

I do not have much knowledge of divorce in Switzerland, but did some googling:

ch.ch says this:

"Child maintenance payments Parents continue to be responsible for supporting their children financially after a divorce. This responsibility ends at the earliest when the child reaches the age of majority or completes a first level of education and training that allows it to start work.

The court decides on the size of the maintenance contributions based either on the child’s needs or a contribution of 10-15% of the net income of the parent owing maintenance. For two children, this goes up to 20-25 %."

Googling on "Scheidung Kinderalimente" I found these Beobachter articles which might be of interest:
