I am a non EU B permit holder (my husband works here in Switzerland, and therefore I got the B permit). I do not work here, and I am thinking about setting up an online shop to sell some handmade stuff. I have a couple questions regarding setting up as sole trader (Einzelfirma).
However I would like to understand if:
- I can set up this sole trader thing given my situation
- what kind of ramifications it has in terms of residence permit and social security registration
I keep reading online so many different things, and even on startup.ch nobody can give me an answer, so If anyone as any information I would really appreciate it
You’ll need a business plan and sufficient funds to establish the business to get the okay from the migration office since this is a change in your permit status. However, it won’t get you an independent permit, just that your dependent’s one will show you’re self-employed. You’d have to arrange the necessary insurances and social/pension payments - and of course check with your landlord if you have one that it’s okay to run a business from the premises.
No, but they want to know you can support yourself financially while getting established. Bank statements, spouse’s payslips I guess, things to show you’re not going to be a burden on the Swiss social system.

Gainful employment (Erwerbstätigkeit) is defined as employment or self-employment. See para. 4.1.1 at p. 12 at the below link:
Para. 4.4.1 at p. 23 says that family members of non-EU B permit holders with a right to work will also be allowed to work without specific permission, in the interest of integration of foreigners.
"Familienangehörige von Aufenthalterinnen und Aufenthaltern hingegen besitzen keinen Anspruch auf eine Erwerbstätigkeit. Im Rahmen der generellen Ziele des AuG – bessere Integration der ausländischen Bevölkerung – wird allerdings auf die Bewilligungspflicht bei einer Erwerbstätigkeit verzichtet."
