Extending non-EU B Permit with my own startup

Hi everyone,

My B permit is about to expire in one month. I am in the process of registering my own company in Zug (I live in Zurich) and it might take more than a month for that to be finalized. I already have revenue and I'm in talks with investors, etc. My wife is also doing a Ph.D. here and I can become dependent on her Student B permit but I'd rather not since I've already got a B permit that is not tied to an employer (open B Work permit) and I don't want to lose it and go through the whole process again.

What would be the best option for me to keep my B permit? I can't use my startup since it's not officially registered yet.

Thanks!

Find a job !

With a non-EU permit, you cannot work for your own, unless the commune/canton agrees for you to do so (it should also be stated on your permit). Your B permit renewal requires you having a job (not a company); so it will most probably not be renewed.

As Biro stated, finding a job gives you a guarantee for that B permit extension.

Good luck.

What do you mean when you say you have revenue ? Do you have a client contract on your name , considering you still dont have a company registered ?

That‘s not the issue, the problem is that a non EU may not set up a private business without approval.

You can do business without having a company registered.

It does not matter what stage your start up is at it won’t get you a work permit even if you are the owner, you still have to meet the same criteria as all other third country nationals. The only people with a right to establish a business are Swiss citizens, C permit holder, EU citizens and to some extent the spouses of Swiss nationals.

Investors talk to everyone that’s how the find opportunities so when you tell them you are talking to investors all you are saying is that you are the same as everyone else and by the way you don’t have the finances to support the business that is trying to justify your work permit.

Get a job or become dependent on your partner’s permit.

Just to add to that, the spouses of C permit holders have to right to start business too.

But if he has a client contract then cant he use that to file for his extension ?

No, because you are not allowed to have your own company before you have approval to do so.
