Hi, new to the forum but excited to connect. I am an EU citizen moving from the USA with a work contract in Zürich. I am married to an American citizen who will be applying for a D visa in the US before he moves to Switzerland. In order for him to obtain his residence/working permit, I believe he will have to submit an FBI criminal record check. He has a misdemeanor on his record from >10 years previously. Has anyone had any experience with these background checks to know what the Zurich canton is specifically looking for? We will also be speaking to an immigration lawyer but I wanted to ask the forum as well. Thank you for any input!
I am not sure they publish details what they are looking for.
It may even not be relevant - I thought that according to the EU rules, criminal checks should only be necessary for exceptional cases, but not sure if this applies to husbands.
For for family re-unification, should you not first move to Switzerland alone (find a home, do the paperwork) and then ‘invite’ your husband? In that case you could perhaps ask in Zurich what they are after exactly for your case. If in the end they need one, you just have to submit what you have, it may well not affect anything. PS: Note that the D visas are limited time, eg 1-3 months, just for the initial move. Then once you and-or husband are in Switzerland, you apply for the definite residence permit.
Agree with blings to just ask Zurich what paperwork they want (without mentioning any potential issues). Bern was perfectly happy with a local police report from my hometown.
