Filing a poursuite

Hi,

I am looking for help filing a poursuite. I am owed one months salary and have been recommended to open a poursuite against my employer. I have all the documents, just need help with the paperwork because I am stuck.

Any recommendations for people that can help?

hi you need to file the poursuite at the "bureau des poursuites" where your employer is domiciled, by letter or personally. you can find the form here and it s better to complete it in French or german.

You then pay fr 73 for the filling ( for amount between 1k-10k).

You do not need to present the documentations at the time of filing: In Switzerland anyone can file a poursuite against one person without any proof.

I have done that but they opposed the poursuite.

I have to 'lift the opposition' and i understood i should write a letter to request the poursuite be continued.

I wrote the letter using my best google translate french. The reply was something along the lines of 'i don't have the right to lift the opposition' or something like that.

I think i have to ask the right person using the correct terminology or something. This is where i am stuck.

I am really looking for someone who has done this before. I can pay of course.

as Ella says anyone can file a poursuite without any proof

so if I think somone owes me money I don't even have to send them a bill I can go straight to the office and pay the money and fill out the form.

they get an avis de poursuite and I suppose they will invoke an "opposition".

so now i just don't do anything else but it then stays on their file and could adversly effect their credit rating.

Is there no way they can force me to remove it??

As far as i understand, the letter i got back said i have no right to lift the opposition.

If the opposition is not lifted then the poursuite is removed and so i guess the person who owes me is no longer listed as officially in debt to me.

It's frustrating for me as nobody has yet looked at my contract to see that i am owed money. All that has happened is that i have filed a poursuite and it has been opposed.

Apparently a judge must look at my contract and lift the opposition to continue the poursuite. But this is where i am stuck. I guess you have to personally know a judge in the poursuite office near the person who owes you?!

I'm also interested in doing this, my daughter was scammed out of 300 francs by someone in Fribourg running a fictitious dance competition. I have a name and address, but what do I need in the way of evidence that I'm owed money, and that I've got the right person?

I know a guy who owns a small electronics company and was scammed out of 1500 CHF of goods the scammer ordered. He filled in one of these and had it executed immediately. Apparently under the new law if foreigners commit these kinds of crimes they can be evicted as well from here, he was settled within a heart beat of filing.

I believe that once your debitor has opposed the poursuite you normally have to go to the local juge de la paix (for small sums) and ask him to lift the opposition on the basis of your evidence. Local here is undoubtedly the place where you are lodging the poursuite, i.e. the place of residence of your debitor.

There seem to be some forms provided by the office des poursuites in Vaud but they are pretty horrible.

Hi i would get an attorney in your case. On the Poursuite office's website, in the Q&A section you can find the exact procedure of what to do if the other party files an opposition.

Le débiteur peut former opposition au commandement de payer sans devoir motiver sa décision. Par cet acte, il empêche le créancier de continuer la procédure.

If you sent the letter to the right juge de la paix I suspect the exact content of the reply will be important (maybe you didn't have the correct supporting documents?).

As others have said, if the sum is large enough you really should think about finding a lawyer.

I sent the letter to the correct office, but not addressed to anyone personally. I think this is the deal, you have to personally contact the correct judge and ask them to lift the opposition.

I sent a copy of my contract with a 2 month notice period, and a copy of my termination letter. The second of the 2 month notice period, ie my last month's salary was not paid. Surely these are all the documents required?

I am not a lawyer, but this sounds a little doubtful to me. It could simply be that you requested the wrong type of action?

I do not think there is much advice people can give without knowing the contents of this correspondence - and for proper advicea lawyer should be consulted.
